You said this on June 22nd:
"Production is slowly ramping up and we are easily able to manufacture 200 units a day currently - there will be no problem hitting 400 units a day once things are in full production."
Its almost September, when do things go into full production?? How many you manufacturing a day now? [don't worry we don't expect you to know, you are just the COO, so no reply expected]
On Jun 19th you said this: ""What's the ETA for new orders placed today?" - Sometime in September is my guess."
90 days. You haven't shipped July 2012 in 90 days.
On Jun 19th you also said:
""Josh, you were thinking all 2012 (non-MR) pre orders would be shipped by end of July, still feel that way?" Yeah, I think we'll get it done."
[WRONG AGAIN]
On June 17th you said: " We have a bunch of singles doing burn in right now and they'll be shipping tomorrow."
It took you in excess of 50 days to get Singles from June 23rd out the door
On June 9th you said:
So far, it's looking like 400 a day was a conservative estimate (that's 400 aggregate across all product lines, not 400 per product line). With a partial team going on the Jalapeno's, we can easily do 200 in about 5 hours.
[Then why haven't you? You haven't got 400 a day out the door EVER]

What'll happen to ASICs when they're no longer profitable to run?
BFL will then ship them to customers.
(thank you, thank you very much)

Will someone tell me what bcp19 exactly wants?
1) I believe (not a fact) that BFL has shipped more than people believe. 2) I dislike the trolls who used 2 data points out of 200 and try to make a valid arguement. 3) I kinda just dislike k9 in general, cause he seems to think BTC is a set currency and not a volatile commodity. 4) I really enjoy laughing at PG 5) I love a good debate 1) A Good debate does not allow name calling like being childish and calling someone a troll 2) Prove there are 200 data points or shut your face - Good Debates use the data available 3) It does not matter how much BFL has shipped, it matters how fast. If Apple gets orders for 7 million Ipads and only delivers 800,000 in a year that matters, especially to the 6,200,000 that didn't get theirs. 4) You sir couldn't debate your way out of a wet paper bag. You lack contrary data, you like to call names, and act like a child. 5) We laugh at you, back under the bridge with you. 1) true. having responded in kind after being called names was uncalled for. 2) I can point to 4,951 of them. http://bfl.ptz.ro/ While not COMPLETELY accurate, it's better than the stuff most people try to use. 3) Actually, how much does matter. People are claiming less than 50TH when fairly accurate data points to closer to 165TH. Defamation works in both directions. 4) You have come late to the party sir, wait until these same people have told you the same thing 20 times after being proved wrong cause they can't accept being wrong. 5) Really? Name calling is childish and yet your IMPLYING I am a troll is not? I challenge you to repent sir. I was not implying, perhaps you were inferring?

So , ahh, all of this is just so much crap until someone provides contact info for some US lawfirm they've approached to represent those who have claims against BFL and want to pursue legal action. Hint - a law firm proximal to BFL HQ is probably a good start.
The one time I've ever had a post deleted on the BFL forums, it was when I was musing about the extraordinary number of day-1 minirig orders, and thinking out loud about how, if it turned out that BFL had provided any kit ahead of the actual payment date for friends and/or staff, it would almost certainly constitute a fraud against their other customers. I did say that I thought this was highly unlikely - but the post got deleted anyhow.
I guess it's conceivable that someone friendly with BFL could come along late and place an order for a dozen minirigs and formally or in informally make their order conditional on jumping to the front of the queue; but BFL would have to realise how that would put the company at risk, so I'm sure they wouldn't accept such a proposition - still, it's something to ponder.
I converted my order to Monarch within about half an hour of it being available, so I am in no position to demand a refund, and I really don't expect anyone angrily bashing away on their keyboards to actually initiate a legal suit, but even if they did I wouldn't be party to it. If I get my Monarch in Dec/Jan I'll be delighted, but if BFL were to offer me a refund in the meantime I'd take it.
Here is a Law firm that would work: http://www.scimlaw.com/

Unless you have figured a way to overclock them, a simple fan blowing on them is sufficient.

Borrowed from the Avalon Lawsuit Thread:
For class action you need:
If you are looking to explain this issue to a litigator, then he'll want to see a few things up front:
1) what are the terms of that governed the transaction? 2) what is the timeline of the parties' statements and representations (who did/said what when)? 3) how many orders were placed and who placed them? 4) what was the cost of each order and the total orders? 5) what orders were/were not shipped?
This information isn't always available, of course. Nonetheless, a class action suit needs a few informed, passionate lead plaintiffs to communicate information like this to their lawyer.
