DUSK is a security token and it can be used to launch other tokens as ethereum does? Please correct me if I am wrong.
Dusk Network's native token DUSK is a utility token. Ok that's good new, the SEC can't touch this ICO then. Only security tokens can be influenced by the SEC afaik. ETH is also a utility token and the SEC has said they would not interfere if the ETH ICO was today because it complies with their rule. So Dusk should be fine indeed. |

Last year there was pure speculation, i reckon we will not see anything like that till there will be some sign of crypto really going mainstream and being actually used for something else than just trading.
Its still a lot of speculation about crytpo but the difference is, they turned to negative ones and everyone is trading in fear which brings bad results. We simply have too many projects and money got recklessly spend and now its lost in scamy projects. |

As far as I remember one of the SEC officials said something along the lines of Ethereum may have been a security at some point in history, but because of the current level of decentralization it is not a security at this time. Crypto currency, utility token, security token... To the SEC it is irrelevant what the asset is called. In order to determine whether it is a security they perform a duck test (does it look like a duck, quack like a duck, walk like a duck? then it probably is a duck), more specifically the Howey test. In order for a financial instrument to be dubbed a security and fall under the purview of the SEC, the instrument must meet these four criteria:
It must be an investment of money
With an expectation of profit
In a common enterprise
With the profit to be generated by a third party.But, since DUSK is not sold to US citizens this may be an irrelevant issue. |

True, but just saying it is a utility token doesn't make it one. Ethereum was most likely a security at the time of the offering as well, but because the platform is now so decentralized it no longer is. Unfortunately the succes of DUSK is still 100% dependant on the developers/team of DUSK, making it centralized and in my opinion a security in the eyes of the SEC. Question is: are they offering to US investors at the ICO? |
