If anyone thinks that the United States government isn't capable of shutting down a cryptocurrency they are mistaken. I agree that although they can't actually technically "shut it down", they can probably create enough fear, uncertainty and doubt to drive the price to the floor. For example by banning businesses from expressing prices in Bitcoin, banning exchanges etc. But lets think through the implications of such a draconian policy for a minute. For a start, they'd have to say goodbye to their "we're business and innovation friendly", "we're only worried about laundering" act. The cat really would be out of the bag and police state exposed. Secondly, cryptocurrencies do not know sovereign boundaries. You'd actually have to get a global level of consensus for such a clampdown to have much meaning. Thirdly, if they did that, bitcoin might actually go up in value because it would be seen the way gold was during the ban on holdings - "to valuable to have in the hands of regular folks". So I see decentralisation of any kind as being very difficult to regulate. In fact we're not even necessarily talking about cryptos "going mainstream", but simply staying where they are while the fiat system decays.

“An administrator or exchanger that (1) accepts and transmits a convertible virtual currency or (2) buys or sells convertible virtual currency,” however, is a money transmitter unless an exemption applies.102
It appears that FinCEN is fine with masternode operation as long as the administrator registers as an MSB.

Masternodes are essential for anonymous transactions on the Darkcoin network so they could claim that they are involved in the transmission of funds. That's all it would take for an overzealous prosecutor to make a name for him/herself. Masternodes are involved in the transmission of funds. That's enough. It's entirely possible that without registering as an MSB you might get a visit from FinCEN for running a masternode in the United States.

The trouble is, when the US Marshals sold their bitocoins, did they go to the nodes that conducted the transactions and offer to give them ID details? No? Arrest them. The point is, they can't. Nodes are pass-through routers. They are not at the initiation or termination of the transaction. That's the sender and the receiver within crypto land. The decentralization part makes this the way to enforce regulation. That's what the nice FenCEN chick was saying on the youtube video. Senders keep records and ID details. The coins don't carry ID, they are eCash. MNs can't ask the coins for ID. Once out of the client, they are in the wild. The recipient becomes responsible for the other end of the regulatory burden - records that need to be kept if needed.

shojayxt, the transparent market is at 99%+. There are hundreds of transparent coins or means of payment that you can use right now. There is no case to be made in their favor as they DOMINATE the market. Most of us in the DRK thread believe in the explosive growth potential of something new, something like e-cash in the form of anonymous crypto. If you don't believe in it, why are you sitting all day here arguing against it, instead of simply buying transparent coins? Why did you even "buy" in the first place - if you ever? So that you can then tell us that you dumped your DRKs - if you don't even believe in anonymity and that it is a stupid idea etc etc? And that suddenly occured to you after ...masternode payments? All the things that you are saying have been said a couple of thousands of pages ago... darkcoin? yeah good luck with that... anonymous transfers? the government will ban you... etc etc... all these and more, like "I'm ok with my BTCs", "the exchanges will not trade DRK" have already been said. A few months later DRK has made its marketcap like 20x. And it's not even close to wide adoption phase due to development.

You're talking about US law etc. , in EU, it's "whatch out" about btc and crypto's. [In EU we are used to say that "your are in advance for 20 years ! (back to 70's 80's") Now it's less.](my personnal thought)]
ALtcoins / BTC are Worldwide today in all continents : Africa, Asia, Oceania, America, Europa. Decentrelized, no fiat, the big problem.

If DRK is widely accepted and used as a payment option what happens if I buy something using DRK and the merchant says they never received the payment? What recourse do I have to prove I actually sent it to them since the transaction is anonymous and can not be tracked in the blockchain?
