- Carlos refused (probably as instructed by his brother) to answer any questions for the SEC.
- The SEC doesn't believe he's mentally incapacitated so its suing to get those answers.

Is that what's happening here?

yep, that's how I understood it too. they're giving the transcript to the court (?) is that how it works?

yep, that's how I understood it too. they're giving the transcript to the court (?) is that how it works?

Sounds about right. This "interview" was more or less voluntary (I think). The next step is probably going to be in a courtroom. If These punks pull that AmmawetardSoSowwy bullshit in front of a judge they just might be tossed in the can for contempt.

I think the point of this is that since it's now a court order, failing to comply would be contempt of court, and C. Garza could actually go to jail. They're betting that a night or two in jail might inspire him to talk.

I'm not a lawyer, but that's my guess.

All props to maildir for continually paying attention and grabbing a case number less than 24 hours after it appeared online. It's the first interesting thing that's happened on this in weeks, and it shows us that the SEC still has an active investigation that they're still putting resources toward.

And it's a decent effort too, at least the few pages that I've read. Concisely and fairly accurately defines what "virtual currency" and "mining" is, and how GAW did what they did. Word "ponzi" is mentioned too.

There's a lot of wisdom in PR's comment here.  A lot of scammers/bad actors/ignorants/incompetents/[insert adjective] dress their schemes/lack of knowledge/etc. in jargon and buzz words they think are prevalent in the industry and without actually explaining what they're up to.  In contrast, great ideas, even if complex, can be shared w/ simple language.  The benefit of the non-jargon approach is that simple language is transparent.  It allows for idea testing; it hides from nothing (like singing acapela instead of with a metal band).  It is inclusive, it invites questions.  In many cases in BTC world, a lot of losses could have been avoided by asking questions the jargon is designed to deter because people don't want to come across as stupid to the supposed industry professionals. Psychology has clearly become a tool for marketers and scammers in the bitcoin ecosystem, its imperative that people arm themselves with good questions and refrain from forking over their $ before legit answers are given.  

Of course, the pattern will repeat itself. For instance, I suspect we'll see another version of this from a certain BTC media company led by someone that speaks in jargon, hype, and platitudes and who doesn't appear to have actually worked in the field they claim to dominate (prior to what they're doing now).  This time, the victims are the employees who were paid to ask tough questions of market participants and failed to do it for themselves.  Its sad, really.

I agree that was a totally coached and thoroughly rehearsed performance from Carlos. He is obviously playing broke and dumb and actually has lawyer(s). Playing the feds like fools just like he played all the Gaw/Paycoin investors like fools. His idiot act is likely to motivate these people and he will soon be in a situation where he will qualify for a court appointed attorney. * I bet he magically finds a way to get his own at that point.

This reminds me of Tio's performance when he showed up at the DEA and gave testimony on BB.
