is there a way to pin down fraser without testimony from garza in court? Not just discussions with the gawsuit lawyers in court. How can Garza testify with the SEC hanging over his head? How does anyone think this is a good plan.

He's the "star witness" so I don't see how this could go forward without his deposition and/or in-court testimony. Maybe Garza is hoping that throwing Fraser under the bus will drag him (Fraser) into the SEC case somehow. Whatever the reason behind this plan I'd like to think that plaintiffs' lawyers know what they're doing. They wouldn't be wasting their resources if this didn't have a reasonable chance of success.

I'm thinking they've already been paid handsomely up-front (in part) for taking on this long-shot case in the legal Wild Wild West of Altcoins.

Even if working soley on hopes of a big commission, they seem to know they are beating a a nearly-dead horse.

The desperate language & circular arguments in the Plea to survive the Motion to Dismiss are so forced, they're actually funny.

TLDR: "The Defendant (Fraser) is blatantly disregarding the fact that he has been named as a 50-50 Partner!!!!" ***

If the intent is to throw the lawsuit, going after someone who can not be proven culpable seems like a good start.

Homero "throwing Fraser under the bus" does not ring true to me at all, either. I think this is all part of an extrication plan. Look at it this way: If a competent legal team went after Garza , they would nail him. That would officially make the Fraser/Garza partnership one involved in fraud schemes. Is it better to be accused of being involved in fraud and cleared? Or associated with proven fraud and left open for future litigation along with having a permanently tarnished business image? The smart money would go for being accused and cleared I think. After this designed to fail suit is tossed out/lost will there be another? Unlikely. Not a major one anyways. Wish we had a lawyer in the midst to obtain a judgement on Homero just for the principle of it.

Hey, if anyone knows the procedure for filing a smalls claims court fraud case it might be fun to do it if anyone knows where Homero lives.  Does anyone know for certain where he resides?  Lexis/Nexis access would probably tell you, but I don't have an account.  I believe some states you can file a small claim entirely in writing.  There were two private individuals suing GAW I believe in Connecticut.  Wonder whatever happened with that case?  It was different than the Allen Shinners case.
