hmm Homero's usual delay tactic to drag it out, thing is there is no mention of who is representing him. I think it might say in the original court document if someone can access it. His answer is due 9/5/2016 , last minute Homero, probably get the extension today too. Friday, September 02, 2016
STIPULATION and Motion for Extension of Time for Defendant Garza to Respond to the Complaint by Denis Marc Audet, Michael Pfeiffer, Dean Allen Shinners, Jason Vargas.(Kindall, Mark) Also this Joint STIPULATION re19 MOTION to Certify Class MOTION to Stay all briefing and other proceedings in connection with Motion to Certify Class by Stuart A. Fraser.(Fisher, Sean) and this, whatever it means: Request for Clerk to issue summons as to GAW Miners, LLC, Zenminer, LLC. (Kindall, Mark)

Motion for Extension of Time for Defendant Garza to Respond to the Complaintby Denis Marc Audet, Michael Pfeiffer, Dean Allen Shinners, Jason Vargas.(Kindall, Mark) or do they just mean the complaint is by Denis Marc Audet, Michael Pfeiffer, Dean Allen Shinners, Jason Vargas.(Kindall, Mark) WTF am I seeing

Garza's waiver was signed by Marjorie Peerce (same lawyer as in the SEC case), so I'm assuming she's representing him. http://ia601502.us.archive.org/26/items/gov.uscourts.ctd.112576/gov.uscourts.ctd.112576.14.0.pdfEdit: and here is the motion to stay the class action certification - doc not archived yet so I don't have a link: WHEREAS Plaintiffs Denis Marc Audet, Michael Pfeiffer, Dean Allen Shinners, and Jason Vargas, individually and on behalf of all others similarly situated, (collectively, “Plaintiffs”) filed a Motion for Class Certification and Stay on August 12, 2016 (the “Motion”) in the above captioned action; WHEREAS on August 30, 2016 Defendant Stuart A. Fraser (the “Stipulating Defendant”) and the Plaintiffs (together with the Stipulating Defendant, the “Parties”) participated in a Federal Rule of Civil Procedure 26(f) (“Rule 26(f)”) conference; WHEREAS the Parties agreed that, to conserve judicial resources and party resources, the Motion should be stayed in its entirety until, including, but not limited to, the Court has ruled on any motions to dismiss the Complaint; IT IS THEREFORE HEREBY STIPULATED AND AGREED by the Parties, that: 1. As requested in the Motion, all briefing concerning class certification shall be stayed until such time as this Court enters a Scheduling Order setting forth a schedule for all briefing and other proceedings concerning class certification. 2. The parties reserve all rights to argue the propriety of certifying the putative class.
Edit2: Garza's extension until October 6 has been agreed upon by both sides too so I don't see why it wouldn't be granted. It's funny though that the motion has been signed by Garza himself: Edited 2020-11-29 to fix a broken image

Thanks. Peerce makes sense, probably still under retainer from the SEC case. I wonder if he is delaying in order to see how Uncle Stu responds first. Pretty sure there is going to be a lot of finger pointing to come. Better not fail us Homero!

This is going to go on and on and on. He will pay a small fine, admit guilt and be banned from running a business for 10 years. Fraser will get off Scott free since Homero admits all guilt.

Nice! Another one I never saw before. Homero and Uncle Stu are being immortalized. Text book and regulation chapter worthy financial big shots for generations to come ! It is only the Financial Industry Regulatory Authority, who is [ the largest independent regulator for all securities firms doing business in the United States. FINRA's mission is to protect investors by making sure the United States securities industry operates fairly and honestly ] No wonder Cantor Fitz. is footing Uncle Stu's legal bill. Holy Shit! Pretty much the watch dog now noting Cantor Fitz's Uncle Stu involved in one of the biggest financial scams of that year. What headache. Shhh don't tell Elise ! http://www.finra.org/investors/alerts/bitcoin-more-bit-riskyIn December 2015, the Securities and Exchange Commission (SEC) charged two Bitcoin mining companies—GAW Miners and ZenMiner—and their founder with conducting a Ponzi scheme by purporting to offer shares of a digital Bitcoin mining operation. This follows previous action by the SEC in February 2014 when the agency to suspended trading in the securities of Imogo Mobile Technologies Corp—which had announced testing of a new mobile platform for Bitcoin a few weeks earlier—because of questions about the company's business, revenue and assets. Also in February 2014, the Tokyo-based Mt. Gox, one of the largest bitcoin exchanges, stopped its operations. It subsequently filed for bankruptcy in Japan and then in the U.S. And in 2013 the SEC charged a Texas man and his company with fraud, which also involved an alleged Bitcoin Ponzi scheme.

This is a lot more serious for Homero than I previously thought. The main body over security operations in the US duly noting this scam as above. Uncle Stu tied in Cantor Fitz. into this scheme. 5 all star big time shooter lawyers rep'ing Uncle Stu. 100% they will slit Homero's throat to clear Uncle Stu and as a consequence Cantor Fitz. from this debacle. This tie-in is a stain that Cantor Fitz. cannot ever have on its name. EVER. You can be guaranteed that in that advisory blurb some back rubbing was done to ensure just 'the founder' was printed (and not founders (Homero and Uncle)). This is bad. Really bad for Homero. The class action opens up the books for all to see and Homero is the only one that is going to go down. Now of course, does Homero have some deep dark secret ace up his sleeve? Apron's and all? This will be very very interesting, the reputation of one of the leading financial co's around vs. the reputation of its former CEO vs. the nothing of a street slug named Homero and his box of glass dildos ! I think we shall be rewarded with a very very entertaining ride ! But then again..... This is what it could all be about. Hush, shhh don't tell Elise. Push comes to shove and here, take this big fat juicy check and make the lawsuit go away. The class action lawyers I think have full control. Exactly what and who they were aiming for from day one. Well done !

MOTION Appoint Lead Plaintiff & Approve Choice of Counsel by Denis Marc Audet, Michael Pfeiffer, Dean Allen Shinners, Jason Vargas.Responses due by 9/27/2016(Kindall, Mark)
Att: 1 Text of Proposed Order, Att: 2 Affidavit Declaration of Matthew B. Allen, Att: 3 Memorandum in Support Tuesday, September 06, 2016
order Order Tue 3:03 PM ORDER. The parties have filed a32 "Joint Stipulation and Motion for Extensions of Filing Deadline" and a31 "Joint Stipulation to Stay Motion for Class Certification." In the District of Connecticut, the parties may not extend a deadline by stipulation. See D. Conn. L. Civ. A motion for extension of time will not be granted except for good cause, "which requires a particularized showing that the time limitation in question cannot reasonably be met despite the diligence of the party seeking the extension." D. Conn. L. Civ. R. 7(b)(2). The parties have not made a "particularized showing that the time limitation in question cannot reasonably be met despite the diligence of the party seeking the extension." Id. The Court also notes that defendant Stuart Fraser previously requested, and received, an extension of time to file a responsive pleading. (ECF Nos. 17-18.) Therefore, the Court DENIES without prejudice the32 "Joint Stipulation and Motion for Extensions of Filing Deadline" and the31 "Joint Stipulation to Stay Motion for Class Certification." The Court DENIES without prejudice the19 "Motion for Class Certification and Stay and Supporting Memorandum." The Court notes that there is no "Supporting Memorandum." "Failure to submit a memorandum may be deemed sufficient cause to deny [a] motion." D. Conn. L. Civ. R. 7(a). According to the record before the Court, a defendant first appeared on August 10, 2016. (ECF No. 15.) Thus, the parties' Rule 26(f) Report is due by September 23, 2016. D. Conn. L. Civ. R. 26(f). In the Report, the parties shall propose a filing deadline and briefing schedule for any renewed motion for class certification. Signed by Judge Michael P. Shea on 9/6/2016. (Hillier, D.) So the extension was denied but it still got extended to September 23? I'm pretty sure the original deadline was sooner than that but whatever.
Only a couple of weeks to go.

This is getting to be SO good. TY @Maildir for your excellent analysis. I have said all along that Stu will throw Garbanzo under the bus. He has no choice. Homero still won't even see it coming, until the witnesses have hit the stand! Stu is lying to his wife, his colleagues, his lawyers and Homero. That's what desperate people do. Will GAWsuit keep its peeps up-to-date with a blog somewhere? Would be fun to follow. In other news: Props 2 @suchmoon for expressing your inner woman with your new avatar.

Basically the defendants did got already an extension. Another extension of time will not be granted except for "good cause" or only if the defendant demonstrates in writing he could not reasonably file a request in a timely manner due to extraordinary circumstances beyond its control (natural disaster or other catastrophe such as fire, etc...). This log is basically a FINALE reminder that the defendants have to file an answer by September 23, 2016.
