The Report confirms that issuers of distributed ledger or blockchain technology-based securities must register offers and sales of such securities unless a valid exemption applies. Those participating in unregistered offerings also may be liable for violations of the securities laws. Additionally, securities exchanges providing for trading in these securities must register unless they are exempt. The purpose of the registration provisions of the federal securities laws is to ensure that investors are sold investments that include all the proper disclosures and are subject to regulatory scrutiny for investors' protection. "The innovative technology behind these virtual transactions does not exempt securities offerings and trading platforms from the regulatory framework designed to protect investors and the integrity of the markets," said Stephanie Avakian, Co-Director of the SEC's Enforcement Division.
In light of the facts and circumstances, the agency has decided not to bring charges in this instance, or make findings of violations in the Report, but rather to caution the industry and market participants: the federal securities laws apply to those who offer and sell securities in the United States, regardless whether the issuing entity is a traditional company or a decentralized autonomous organization, regardless whether those securities are purchased using U.S. dollars or virtual currencies, and regardless whether they are distributed in certificated form or through distributed ledger technology. so, expect US based ICOs to shutter, its not safe to do this without registering anymore, and it takes a few months, if not years, to do so.also, you may see exchanges stop offering these securities unless they go into compliance. this will greatly enhance the quality of these offerings however, they simply wont be able to pull that anon team bullshit, or perpetrate outright scams. the laws is watching now  I wonder how this will fair for ICO that are in between their pre offerings and live ICOs, as well as those that are due to start in the next few weeks, that are US based or offering to US investors. I am a foreigner living in Berlin. I married a German person who did really evil to me and now I need help. Before we left my country I gave him money and he bought 10 bitcoins for me. He said I should keep it for the future.
Time passed and after 11 months after the marriage he asked for the divorce. By that time I was still unamployed learning the language. He left the house one month later saying he would still pay the rent and assist me. I continue trying to look for a job. He was oblyged by law to give me the assistance for that I still havent the job to pay my bills.
What he did: stopped paying the rent and the bills and did not let me know, only comunicate dmy lawyers when I had a debt of almost 2.000 euros. He hid his income and give me an assitance of something like 400 euros. What I earn makes 500 euros. He doesnt want to help anymore, I have the rent, all the bills to pay, and I am trying to find a roomate asap.
I am thinking of sueing him, but he says he shouldnt even be helping me in the first place because I have 10 bitcoins that now might count like 10.000 euros and I should just use them.
But I didnt made this investiment for this. I never made a trade (Im a Holder) so I would like to know what to do in this case. Can my bitcoins count against me?

US regulators act from an excess of caution, primarily as a result of the anti-money laundering regime that was instituted after 9/11. Rather than face legal challenge later on, why not just concentrate on markets aside from USA. There are indeed enough investors outside of USA, who can launch and fund a project. Unless of course, SEC would soon issue a legal framework to work with, then it is not worth including USA in any ICO issuance. The report spends a lot of time establishing that the DAO was in fact a centralized organization, describing actions that run parallel to those of any struggling start-up which has actual control over its resources.
The issue of whether the DAO had sole discretion or full control is important because it then implies responsibility for investor losses as a result of security malfunctions. Legally, it opened up a can of worms, which is why the SEC commissioned the report in the first place. The authors appear to be intimately familiar with blockchain technology, which is refreshing and scary at the same time.
"Whether or not a particular transaction involves the offer and sale of a security—regardless of the terminology used—will depend on the facts and circumstances, including the economic realities of the transaction. Those who offer and sell securities in the United States must comply with the federal securities laws, including the requirement to register with the Commission or to qualify for an exemption from the registration requirements of the federal securities laws. BTC gambling sites are barely legal as it is, especially in the US. As for exchanges, the ones that deal with fiat are already subject to KYC/AML regulations, sometimes to the extent of doing long questionnaires about the purpose of the funds that you're trading there (Bitstamp does these sometimes). Altcoin exchanges could be just one step behind - Bittrex already has a withdrawal limit of 1 BTC equivalent for unverified accounts per day. If mixing sites closed down there would still be ways to stay private, but the careless and less knowledgeable might get caught. I also doubt that Bitmixer was under direct threat from authorities but they could feel that they should shut down before it gets too serious. according to current aml/kyc law, that they accept deposits from users and hold them for any amount of time, they would be subject to identifying the customer over x funds. also, mixing coins is the definition of money laundering from a legal standpoint. imagine if someone could trade dye stained bank robbery bills for fresh, clean bank notes. that is essentially what this is, just programatically. i think, given the current legal climate (Sessions is cracking down hard on the darkwebz), BitMxer is making a timely exit, before the SHTF. The report provides a state-by-state breakdown of these figures, as well as some context on the other side of the coin: Walmart's huge share of the nationwide SNAP, or food stamp, market.
"Walmart told analysts last year that the company has captured 18 percent of the SNAP market," it reads. "Using that figure, we estimate that the company accounted for $13.5 billion out of $76 billion in food stamp sales in 2013."

If there is any way to contact the seller, and if he received the payment and is honest enough, may help you. Hansa was apparently compromised by the authorities for a while now; they wouldnt have shut down the investigation unless they were finished. you may have sent your money to a LEO lol, but any seller on this market is known by international law enforcement, and most likely will be facing charges. you probably wont be getting your coins back honestly, id let this go; if they start going after customers you may have bigger issues than some missing bitcoin. dont reach out for your coins. you are building a case against yourself for conspiracy to commit. DO NOT CONTACT the seller. trust me on this, if you have never trusted a stranger on the internet before. You have no recourse under law to get your coins back, not only are they evidence, they are illegal proceeds. and Sessions changed the asset forfeiture laws like days before this happened, dont think thats a coincidence. |

No, bitcoin can't reduce unemployment. Imagine if 100 people buy 1 Bitcoin at price of 200 USD after few years they find that price of bitcoin goes upto 50,000 USD and they think it's better to leave their "Finding Job" and take interest in Bitcoin and after few weeks Price of bitcoin goes down and deepdown to 1000 USD what they will do? they have to start again to find job and they wasted their time. Anyway, I am sure this can just be an isolated incident and things can get back to their feet soon. usually we dont answer these, but I see you have a legitimate question here. I checked out your website, nice list : i may submit articles to a few on your list it works like this; there are various signature campaigns around that pay an amount per week based off of your forum rank and posting activity. with a new account you might be able to get 10 bucks a week; with a mature account you can make about 70-100 a week, depending on bitcoin price. depends on where you live; if you live in an economically depressed area its a great deal of money. But if you live in the States, or the UK for example. you might cover the utility bills/car note with it. far cry from a "living", so to speak but, if you hold the coins and the price double, you have double the earnings takes over a year to get to the forementioned point, so it something that should be organic, not a goal. |

I think I started to like coinbase  Would I trust my precious coins to them? No, not yet. They have a long way to gain my trust but I may stop talking shit about them for a while.
