How does one receive 200 boards and get them assembled/packaged and shipped out the same day?

Not very long ago it was:

1. Get the boards
2. Assemble them over a few days
3. Ship them over a few days...

So approximately AT LEAST a week.

Now they got it down they can do it in under 15 hours? Given most postal businesses are not open longer than that in a single day.

I am afraid you are incorrect. Contracts of sale cannot be unilaterally cancelled unless the contract explicitly allows for doing so.

Just imagine that we agree today that I would deliver you 10 bushels of wheat in 3 months for a given price. If 2 months later the price goes up, I cannot unilaterally cancel the contract and give you a refund.

As for damages, one can calculate the earning capabilities of the item that was ordered, and one can seek compensation for a reasonable period (few years) of use. It would be several thousand dollars at the very least.

What you've described is in fact a very specific type of sales contract usually called a "forward contract" - If the buyer could produce such a contact then there would be a legitimate case for damages incurred. However, never was any such contract offered by BFL... so I doubt the OP has such.

I respectfully disagree with what you say.  What is special about a "forward contract" is that the delivery may be well in the future, and in most cases so is the payment.

In the case of BFL, they accepted payment now, and promise to deliver. Failure to deliver on time (or within reasonable time) is a breach of contract.

For example, if I sell you my car, and you pay me the price, then I cannot unilaterally change my mind, and simply give you back your money. I will also have to pay you all damages that you incurred from my failure to honour the contract.

No .. you sign a sales contract which specifies the price and the contract which details the terms of the sale.. usually the contract is binding upon two conditions 1) the money being paid 2) the car being taken.  Both of which are considered binding separately and indivisibly . i.e. if you take the car you are required to pay the money or if you take the money you are going to take the car.

So .. if condition 1 is not met then condition 2 cannot be met either.. i.e. if you don't actually have the car in hand you can't be expected to hand over the money. To be even less blunt .. you can't demand possession of something just because you have the money in hand to pay for it.

There are many victims of Sonny Vleisides and his merry band of crooks. BFL is just now managing to ship a few Jalapeno v0.5's to people that ordered in June of 2012, despite the numerous assurance that BFL had honest abe "scheduled shipments" several times over the past 11 months. The lies are too numerous to count.

None of these newbie accounts defending BFL are even old enough to have been created back when BFL's COO Inblahblah was attacking Tom of BTCFPGA for being too vague about his power specs and insisting that BFL's were solid. Specs that were obviously never measured as BFL had zero chips, by their own admission. That, like nearly everything else Josh Zerlan says turned out to not be true. That supposedly solid power spec of 1w/Gh/s was just more fairy dust nonsense designed to suck the life out of BFL's legitimate competition and trap pre-order funds into a constantly evolving pyramid scam of orders.

Tom has a scammer tag for failure to deliver & deceit, Josh's is long long overdue.

Also, you still don't have an example of a major retailer who charges full price for pre-orders eh? The duke nukem pre-orders were deposits, not full charges (the CC companies would have charged them back after 30 days otherwise). So you default on all arguments. Full disclosure, I do have several orders with BFL.  I am happy with my experience.  I am also happy with the returns I will be getting when ever my product lands on my door.

Though, I think that's mostly because I came into this with my eyes wide open, had experience with several different small companies/startups, and am willing to accept whatever loss I take before I see gains until I decide it's too much or a product is delivered.

As, far as the hate speech goes, these are forums on the internet.  Everybody loses their shit eventually on people that annoy them, if it's too much log off or whatever happens is just that. Smiley

I just hope people in the future can take responsibility for their actions, maintaining their business relationships, and their own decisions. You'll never be able to sustain a mining business without thinking about business concerns.

Your own "truth" really? Give me a break. There is little thing called reality. It is obvious to most anyone just reading Josh's posts alone that BFL is a world of denial. Your support for them as tepid as it is doesn't do much of anything. You have clearly agreed with the basic premise BFL is not delivering as promised and they can't be defended in any way  shape or form given their business practices to date. There will be repercussions that linger in this community when BFL implodes in a few weeks or months. Rather than supporting a company potentially ranging from the minimal it has issue in PR and Production to the maximum BFL maybe fraudulent and criminal in its behaviour I suggest you pull your orders in solidarity and help pull their house of cards down now rather than string along more people needlessly. At this point your feeble whitewashing of this as some how necessary for the good of BFL is simply the most outrageous form of either hubris or self-denial I can't determine which.

These threads are a VERY VERY important lessons for those new and less informed that there are people in this community, particularly those at BFL, have no regard for the forward movement of Bitcoin. The glaring differences of Avalon and BFL are so stark that one wonders how on one hand a group of people attempts to "corner" a market and fails miserably while another attempts to drive a wedge into any attempt for anyone to corner the market and are in a position to corner the market but instead seek alternatives at their expense? To me when you look at what those two brands represent. One actually delivers honesty and the other lacks any form institutional ethics and openly flaunts their disregard for the entire community.

Remember I am not a PRO...

I have read through a lot of the specs on the manufacturing of the boards and have a general idea what we need here from a fabrication house particularly with regards to re-flow for the QFN chips and solder etc. I will be using either a Korean, Japanese or Chinese owned subsidiary fabricator here in Jakarta region for the full assembly so there are more than competent to do this work and you get the benefit of me going first and having my chips be the guinea pigs and that would be max a 100 but possibly a 50 board run depending on how many more chips I buy on top of the 540 I have in the Group Buy #1 Raging had.

I want to work with DABS on his chip buy as I think that would be a great option to get chips into the region. I have a limited number of chips that I will buy for the first run as I said and it will be a first come first serve set up and no shipping inside or outside Indonesia. People will have to bring Rupiah, BTC or FRC to seal the deal. What you will get are boards that have already burned in for 12 possibly 24 hours hopefully using Modular Python Bitcoin Miner.

Yes you can. I am located in closer to the airport so reaching me won't be too bad if you have a day or two in Jakarta could be possible.

If you are looking for a Klego build I think getting chips and then working that out as special build could be possible as that could lower the over all costs for me on my smaller chip run. But ya you would have to shell out a bit of money on the chips depending on what you want to go for. But I think that would have to be a long lengthy talk and determine what you want and so forth not suited to this thread. The larger farm units I am very very interested in designing but not with these 1st Gen Avalon chips... I would rather do that with 2nd Gen as they would I think have a much better economy of scale price and speed wise and that would make say a 4 U rack server a much better beast than what the K16 boards are offering.

Remember the K16 might be a K64 as a single board depending on how BKKCoins could modify it and because they will be easy to daisy chain I am seriously planning to have 2 layers of 256 in my first rig or about 144 GH/s. Just remember I am doing a limited run of boards so there won't be many K64s more likely everything will be K16s and you can daisy chain them. If I have some extra single chips I might see about some K1 Nanos.
