Wonder why they don't sue Garza individually since they're alleging fraud? Might as well stick it to him and not let him get the benefit of the corporate shield. Also, what's up the federal securities and commodities claims (see claims 3 and 4)? Seeing as this is a Connecticut lawsuit in a state court, I'm not sure how those federal claims are actionable in state court (i.e., how does state court have jurisdiction?). TBF, I suppose there could be a Connecticut law authorizing these claims some how, like if their state level statutes say any violation at the federal level is a violation at the state level (just making up this example to make a point). Notwithstanding the litany of claims, the real claim here has to be fraud because if these folks (GAW, Paybase, Garza, etc) are find-able, they would be crazy not to seek bankruptcy protection quickly given the Mississippi Power Co default judgment. Fraud is the only claim they're making not dis-chargeable in bankruptcy (I think).

This is a great read. Very sad and funny at the same time, and sums up the scam very well. Hard to believe how much some people believed into Garza's obvious bullshit.

I have to admit I only skimmed through the documents but it sounds to me like Mr. Aviles and Mr. Zapulla are trying to double dip here. It looks like they invested $7000 and $3000 respectively in Vaultbreakers and then some additional funds during Payflash crash (~40k XPY) but are seeking compensation based on a much higher XPY value while at the same time alleging the whole thing was fraud. I can see how they could seek to get their initial investment back but the rest of it sounds shaky unless I misunderstood something.

Did they really not give back 38k paycoins from paybase to these two guys? That's how you know we're dealing with real scumbags. At the current price those coins are worth like 200 bucks, Garza really took every last cent he could out of these intrepid investors.
If it was really a failed investment/company whatever, they would give back the 200 and move on, but since we're dealing with total crooks they keep every last cent they can.

Interestingly enough, the one actual feature of XPY has been a big part of the whole scam. The fast transaction speeds have been being used in bot shuffle mixing millions of Paycoins to obfuscate who is doing the dumping. This started at launch, and has not let up or changed at all since then. Maybe there are different factions with large chunks of the premine, but the fact remains that the operation has not changed in the tiniest bit. If there are actual battling factions, they are definitely working together, otherwise it would be a race to clear the orderbooks, which any of the supposed "Not Josh" players could easily do several times over.
I don't disagree with your analysis but 'fast transaction times' are a marketing fantasy in the alt-coin world. Likely we will see large institutions with private blockchains claiming 'fast transaction times' and other ideas from the current proof of concept shitcoin environment to their customers ... it's only just begun. just saying that IMHO every feature of paycoin was only there to bring money into the scam

If it's a double dip then the courts would likely pick the lowest cost out of the two but I'm pretty sure it would be the first real lawsuit over a scammy IPO and fraud in Crypto and the courts will end up making an example since governments are afraid of Cryptocurrencies.

Yeah I've noticed a lot of former Homero fanboys love themselves some DMD, too. "Chief Visionary Officer" - That is so Homero a bullshit title. Couple that in with a proof-reading fail on his banner (what is it with Garza-goons and their inability to use spellcheck?) and we've got all the fixings for the next rounds of, "Fool me once, shame on you. Fool me twice, shame on me. Fool me repeatedly with obvious-scam-is-obvious scams because apparently I get off on feelings of shame and self-loathing".

A Josh Garza would offer at least 100% never obsolete interest rate and a decent floor.
