Failing to deliver is not their major sin. If they've only failed to deliver it would not be such a problem if they've issued refunds, like Avalon for instance. Failing to deliver *and* keeping customers money is a daylight robbery.

Complainant pre-ordered his Baby Jet unit in order to secure his status as a “Batch 1” customer, 
meaning he would receive a unit from HashFast’s first batch of production.
All HashFast Batch 1 customers were offered a final shipment deadline of December 31, 2013.

I did pre-order a Batch 1 BJ stated as ‘in-stock’ and ‘Shipping Oct 20-30’ on the HashFast order site. The December 31st deadline was not part of the Terms of Sale I agreed to at the time of the sale. Nor did it appear on my BitPay and HashFast order receipts. The final shipment deadline was added after the fact. It was added to the 'order confirmation' that I receive a week after I completed the transaction.

Complainant alleges that the only option HashFast gave it’s customers to pay for its products was in Bitcoin. 
In reality, besides Bitcoin, HashFast accepted (and still accepts) most traditional methods of payment such as checks and wire-transfers,
and Complainant was free to pay for his equipment by these means if he so chose.
It was not until online purchasers made it all the way to the “checkout” page that they were
offered the additional option of paying in Bitcoin, in addition to payment in USD.
HashFast accepted payment in Bitcoin as a convenience to its customers.

At the time of my order (Aug 9), payment in Bitcoin via BitPay was the only payment option available to me on the website. It was only after the widget broke that HashFast accepted alternative methods of payment.

- Shipments begin: October 20th-30th, in order of purchase
 - Payments to be made in BTC with the help of BitPay

Orders are taken in BTC, in the unlikely event we get to refunds they will be given in BTC.

nor do the ToS state that a 1:1 Bitcoin refund would be given. In fact, the absence of any such promise is not coincidental

As such, Bitcoin is a fluctuating virtual currency. It is not a standardized unit of value.

In fact, John Skrodenis from HashFast did make that promise to me in person during my visit to the HF office in SF on October 30.

But it also states (at least in my order confirmation):

So the payment is clearly BTC based. Unless otherwise specified a full refund should mean a 1:1 return of the original payment.

This is an unwarranted and untrue accusation of my character. In fact I have always been clear from the start that I expected refunds to be made in BTC and well before the value started to appreciate. For example on Aug 09 I wrote the following:

In addition, I filed a refund request within 10 days after HF defaulting on their advertised shipment date of October 30.
My refund request was ignored by HF and closed without response (see: https://i.imgur.com/qPrxhmE.png).
To say I was motivated by the USD value at the time of the complaint is baseless. If any party was motivated by the USD value it was HF as is apparent from their actions that are contrary to their earlier statements and terms.

I have already given up and accepted my losses. I'm making this post simply to set the record straight. I wish those that are taking legal action against HF all the best.

We know they lied, and the quotes in that response are all irrelevant when you consider the direct promises made by hashfast during the selling phase of the scam. They are treating customers like shit, and you need to get a lawyer and sue them, not just sit back and accept the loss. Someone needs to stand up against them.

Good idea but HIGHLY doubt that will happen. But wishful thinking.

If they didn't compensate us B1 customers that helped them get off the ground, I highly doubt they will be there for anyone else.

Actually the Second Batch machine, the first Sierra, is 1.2 TH/s, not 2 TH/s

None of them have been shipped

They should come with MPP that would increase the performance beyond 1.2 TH/s but they did not even ship out any MPP even for the Batch #1 BabyJet customers, so I would not count on it

but on a serious note... isn't the other 60TH - RMA machines (faulty and returned, waiting on replacements?) I read somewhere that they had initiated the RMA process. i may be wrong but it looks like icedrill's returns will be processed before any batch 2.  Undecided shucks.

Cointerr has units in customers hands - lots of units. hashfast has a massive line of customers still waiting on the MPP (which was a protection against late delivery - ohh the irony)

They then go on to flail wildly about having a 2.1TH miner using 3 chips. That means that the miraculous 800GH chips are actually running at about 700GH, or almost 15% under spec. I could shove 20 antminers into a server cabinet and call it a 4TH machine - would that make it a better product then hashfast's pathetic 2TH?

..the answer is yes. I would have those 20 antminers in a cabinet in less than a week from today. Hashfast might ship something in a month or two or three. Obviously my 4TH antminer system is now the greatest bitcoin ASIC of all time by hashfast standards

The wild flailing (and OP) are about HashFast's new world record holding 750+ GH/s ASIC.

The 2.1TH Sierra EVO using only 3 chips is just one possible configuration and it comes in a 4U box, unlike a 4TH antminer (which would take up about 6 times as much space).

If HashFast's spec-smashing 2TH is pathetic, then what are CT's 20% power and performance misses?

In one of the threads that hit Reddit last week when gmaxwell called them out one of the comments said they were overdue on paying their bills to suppliers.  Granted it's reddit so who knows what the truth is but makes you wonder what the heck is going on over there.  The profit margin on these things should have been huge and based on the info in the response from their lawyer to ninjarobot's consumer complaint they have only refunded 30k of customer orders which is like a total of 5 BabyJets.  They still have the vast majority of customer's Bitcoins.  Sounds like they are the ones trying to hang onto "windfall" profits, what a bunch of dirt bags.    We need to spread the word outside the bitcoin community so these clowns are blackballed in the wider valley as well for their sleazy behavior.

Haven't even heard them claim that they've sent upgrade boards.   I guess they've sent one now.  And yes, that does seem to be their MO.

Some people concluded that the guy a couple weeks ago who sold a couple of BJs with 2 boards on ebay got his upgrades, but what I think was going on there was that he had several BJs and put two boards into one machine... leaving him with a couple of shells.... as he was probably trying to max income from selling hardware earlier while anticipating arrival of MPP and/or upgrade boards.
