Im pretty sure they can get away with it in china. And that the chinese gov would just laugh at some german lawyer who came and wanted to sue someone in china for delayed delivery.

I think I'm gonna puke !
02/07/2014 - 05/14/2014 - 2600Gh/s - BTC 27.8429
(Pre comp figures @ 1 x3 & 6 x1's)
So ya, F all the people saying don't cry about compensation because BA doesn't owe us anything beyond what we paid for.
Kiss my fat a$$ !
The initial delivery date should have been 2/24, not 2/7 02/24/2014 - 05/15/2014 - 4Th = 30.9201 BTC (my loss from 2 X3's) Another thing that calculator doesn't account for is how much BA would have pumped out in hardware which would increase difficulty and lessen the profits. So with all those roughly accounted for, I am guesstimating about 25BTC profit loss for my investment.

One bit of good news, I like david from BA, he's never really steered me wrong... on an unrelated note for the reason I contacted him. He did tell me he'd briefly "his word" look in to the unprofessional, sell it yourself comment made to a member here.

I just don't understand why a company would treat customers like this. Surely you would understand that it isn't good for business and that your name/brand is going to suffer badly unless you turn this around right now, give us some good news and stick to your promise! For once !!
I don't think there's intentional malice on their part. They aren't sitting around watching the forums laughing as the pre-orderers squirm. I'd imagine they are trying to ship a product. However late they are, however more late we think they're going to be, however bad the ROI is, and however better the compensation is I feel like at this point we just have to see what happens when they ship. More of the same complaints is just adding to the noise.

Debitme, the surprise they promised us around the time of shipping will be that there are no miners and they're running away with the money!

Debitme, the surprise they promised us around the time of shipping will be that there are no miners and they're running away with the money! HAHA, what a surprise. Only difference is that would not make me happy for choosing BA. I am guessing the surprise will be all orders will be doubled, free PSU's with all units, and every unit shipped will come with a free 1 chip version of their scrypt machine! In reality, I bet the surprise will be, the LCD screen will display the price of bitcoin from MTGox's API. lol I doubt anything will change since they already sold PSUs to people like me and they don't want to offer any refunds. If we are lucky maybe some cloud hashing crumbs will be doled out.

Let's not forget, the X1 cases are still 2+ weeks away so we're being extra screwed compared to the X3 orders. Also, that double hashing board is for the X3 only, where's the working hash board for the X1?

As a fellow X-1 Buyer, were quite a long way out. They should just use the two chip board for the X1s. It would make a lot of sense, instead of the current compensation plan for X1 miners.

They really not want to refund, even If I ask for lower refund than paid! Dear Customer,
You have contracted us to manufacture a bitcoin miner. We cannot "unmanufacture" it to refund you. Your order has been manufactured and we'll ship it to you shortly.

At this point since X-1 customers are looking at mid June\late June possibly July delay, the only proper compensation would be adding a single X-3 module of 1 TH/s in addition to the 50% compensation. Obviously PSU's should be thrown in for free and next day shipping.
X-3 customers since they actually have a case based on bobsag3's visit are looking at mid to late June delivery so it should be 100% compensation or 2 TH/s for every X-3 purchased. PSU's thrown in and next day shipping.
Only fair for a 4 month delay.

........... I have send a REFUND request for my (Batch 1) Orders #2120 and #4421 right now via the BlackArrow Ticket System as well as per PM here on Bitcointalk.org referring to the Ticket IDs. I paid for the X-3 back in November 2013. I still got no shipping or anything else.
For me, the refund is the better way due to customs and other taxes and high power costs (Europe) in the future of this issue.
If there is no refund answer from BlackArrowSoftware (HK, first order) or Destino Limited (UK, X-3 PSU order) until this month I call a lawyer.
May THIS is the answer: I asked for a refund but BlackArrow told me they "ship within the next few days". I want to get a refund instead of the product.
BA told you? E-mail? Screen (proof) please.... Thx! They told me this after my refund request tonight and only here the blackarrow in this forum. No real proof is possible.

Could the current x-1 PSU support this? It doesn't matter even if it did. There are still no cases for the X1 and if they used the double hash board it would require a complete redesign of the case because it has 2x the heat to dissipate.

Could the current x-1 PSU support this? Even if it could the board in the x1 sits vertically not horizontally and the x3 board would not fit at all. Not for nothing bobsag said the cases were 1 to 2 weeks off not 2+ so we can hope for better than everyone is assuming.
