Clearly HF is in a difficult situation now. They are delayed and need to take some steps to compensate for that. As Wesly already pointed out, compensating Batch 1 customers will piss off Batch 2 customers and so forth. Pleasing everyone is not economical (HF is a company that needs to make money after all).

So how about this: With the delays and extreme difficulty growth it is obvious that even with MPP after 3 months Batch 1 customers are not going to break even. Knowing this, why not ship the MPP modules on an accelerated schedule immediately after Batch 3? This should not add significant cost to HF, respects Batch 2 and 3 customers and gives Batch 1 customers a slightly better chance of recovering their investment.

When it comes to Sierra upgrades: Offering upgrades from the BJ case to the Sierra case for Batch 1 customers would be a nice gesture, but personally I don't care about the case since it will be easy to make the modules work with any off the shelf case anyway.

i'll take 9 of your BJ's for $1250 each.
It's about how much it will cost me to have the initial amount back following the legal route. So that route is preferred, again. Expecially if i can find other people to share the cost of the laywer with.

you're in Batch 1 with MPP, correct?  what's your order #?
One of the last ones. Yes, batch 1 with mpp. Also, they told me that the units would be delivered with sierra cases since that i asked.
But hashfast has the super facilities to delivery 500 boxes in 1 day, right? So why do you care about the order number?

You guys should group together and hire a lawyer to demand a refund. HF new there could be delays when they published the October dates, that's why their guarantee says they only have to deliver by January (or whatever) in order to pay a refund. 

As per the FTC rules everyone knows, they're legally required to offer a refund until they ship. And frankly, even if they ship tomorrow you won't make your money back.

Only problem is legally they may only need to refund the US amount you paid.

I've already opened a thread to gather people to make a cause against hashfast with, but there where no success until now. However i'm proceeding by my own, i'm having a good email conversation with a lawyer in this moments...

I shouldn't have used the word "case". What I meant, and should have explained, was a Sierra ready to be fully populated with the forthcoming MPP miniboards (i.e. with boards, fans, power supply, etc...).  In other words, ready to be hashing the same day that the MPP miniboards arrive with no additional customer expense.

I know some people think that's trivial, but if the profitability of these machines is marginal at best, saving that hassle and a few hundred bucks per box in extra hardware costs is helpful.

Again, I'm not saying this is *the* solution, it's a step in the right direction...

Your best bet may be to try and cancel on the grounds that the verbiage had been listed as "shipping Oct 20-30" in the forums and on their website while the Dec 31st date was buried in fine print, but you would have to push pretty hard (pun partially intended) to get any kind of legal recourse through. They most likely aren't just going to give you your money back, there's a reason they weaseled that "guaranteed" date into the fine print.

Meh.  Seems to be kink.com.  So what?  They hired a guy that worked for bondage video producer.  Questionable career choice, but not really germane to the question at hand.   I don't think he was on the "team" until a few weeks ago, IIRC.

I think that is a fair question.   They would not deliver to the office but there should be stuff at the Montreal assembler.   Obviously, there would be cases/fans etc. there by now.   I am not sure if people are there, but a few pictures would go a long way.   Or maybe a few screen shots from TSMC's great order system where you can monitor the status of your chip through the process.   I think CIARA Tech has the same type of portal that you can see your job status.
That seems like a fair request.
