hehe tho, personally assuming you dont sue you are better off just getting the unit and mining. if you just get the refund it will only be 5-6coins vs mining you will make more in the first month

Some are saying that if you ordered later with the direct wallet (not the bitpay ordering that was only available on day 1), you might be able to get your original BTC back.
Personally I like mining, though I will almost definitely not recover the 60 BTC spent on day 1 (even with timely MPP). And yes... you would be an idiot to ask for a refund if all you are going to get back is a locked in 90% loss.

You forget that most people paid 50 btc per unit back when they were taking pre-orders. No way in frozen hell that a unit will mine 50 btc in it's entire lifetime. So no, a refund would be the better option if they failed to deliver.

HashFast seems dead-set on refunding the USD value only, though. So even if you paid 50 BTC, you're still only getting 5 to 6 BTC back.

They went on for months saying that the refund would have been of the same BTC amount, and they never said the opposite for batch 1. What changed is the ToS for new customers. However, this is a non issue, they will deliver the first batch. The problem is the MPP.

If Hashfast incurs exchange rate losses due to Buyer’s failure to pay when payments are due, Hashfast shall be entitled to equivalent compensation from Buyer for such losses. Hashfast is not responsible for pricing, typographical or other errors in any offer by Hashfast and reserves the right to cancel any orders arising from such errors.

The spelling mistake has been pointed out in this thread before and they received email about it.
