I would honestly like an explanation where in that response you've found a confirmation that the full amount of BTC would be returned? Cycloid asks if he will "get the same amount of BTC back", and Simon Barber answers "refunds ... will be given in BTC." Just for a second make an assumption that Simon Barber is a ruthless scammer and that he made a vague answer on purpose, where do you read "same amount of btc" in his answer?

Does it matter if they don't have the funds to repay and all the BTCs have already been spent? As far as i can see, the only chances of BTC refunds is if they self mine. The question is which is the least worst option. Waiting for a refund that might never come or Taking the kit whenever it is finally delivered, assuming they can everything to work in the end

It is a common myth that Bitcoin is ruled by a majority of miners. This is not true. Bitcoin miners "vote" on the ordering of transactions, but that's all they do. They can't vote to change the network rules.

So has anyone at hashfast posted here?

On very rare occasion.  These hashfast threads were started by HF people.  They could lock them and let them fall of the map... But I suspect they like the "publicity."

Now since the only payment option is in BTC Will I get the same ammount of BTC back should you fail to deliver by December 31st?

Orders are taken in BTC, in the unlikely event we get to refunds they will be given in BTC.

This response sounds an awful lot like a confirmation that the same amount of btc will be returned.  Thanks ninjarobot for bringing this quote back up.

I'd say that his quoting a guy asking precisely the question "Will I get the same ammount of BTC back"? leaves very little room for playing games with semantics.

Not looking good for Dec 31 shipping given these last few thread pages Sad

Remember, it's "delivery by Dec 31". We've already passed the point of possible delivery for a lot of people, i.e. International customers.

It's a tough row to hoe, but they can still make it for most of the planet if they ship in the next couple days.

Express out of Montreal in time to catch the PM flights over the Atlantic ... North America and Europe easily, even if shipping Saturday.  Most of Asia too.  Major cities in other places probably as well.  Not cheap, but possible.  I'd expect that covers 90% or more of their orders.

I just want to remind everyone we all know what it says in the terms, but just because the terms say something doesnt mean they will follow it.

No... but I am getting the feeling that they are quickly finding out that they aren't as smart as they thought they were.

Delivery as far as HashFast is concerned is delivering it to the courier to bring to you. The terms were EX WORKS, so once the goods are loaded up on the FedEx/DHL/UPS truck, HashFast's obligations have ended. There's a whole bunch of other scummy stuff in the (multiple versions of the) ToS, but that is pretty standard. It really isn't HashFast's fault if your unit gets stuck in customs in Upper-Tzatzikistan for an extra week. Now the two month delay from October to now is another story, but that's pretty well covered here...

What do you all figure the probability that HashFast WILL deliver by December 31st? I'm thinking around 70% chance. If they had some pictures of wafers/silicon, I'd think higher.

Last November, I asked this question, and some people responded optimistically with 90+%. What do you guys figure the probability is at now? I'm thinking 40%.

0% chance of delivering the entire batch 1

Still a small chance they'll do a BFL and ship a few pre release prototypes to reviewers in time (and announce that they're shipping triumphantly)

It doesn't matter when they ship the first Baby Jet. It only matters when they ship YOUR baby jet.  Unless we are talking about some bet or something, refund happens if you don't get yours on the 31st.

Shit, I'd be happy to be stuck in Upper Tzatzikistan for an extra week, provided I had enough pita bread.

More seriously, my unstated assumption there was that "delivery" could be construed to include situations in which the product would arrive under ideal circumstances - customs, weather, broken airplanes, etc... aside.

If ciarra is as good as everyone says, it won't take them long to work through the entire batch (3 days max?).  I have a feeling having a day 1 order (like me) won't mean much.

As a note of interest: being in Quebec, Ciarra should be closed for business Dec 26 for Boxing Day.

HAHAHA. BS. We don't give a f*ck if they start touring BJ's around the country. It's based on actual DELIVERY. Not based on stupid product "truck load" crap. No need to bend over before the party ends.

Actually i think that the tos are quite clear that they are using EXWORK terminology. Delivery = To the courier. However if that is correct, why they upgraded everyone to overnight shipping?
