CrossPost from the BFL BA Forums:
"Well, we have now moved from, "the compensation will be reviewed once mass shipment has started" to, "compensation will be reviewed once we have shipped all orders." "If anyone thinks that after they accept their orders that BA will send them anything else, they are delusional. And let's just assume for a second that they do send out extra units, we have no timeline as to when they will send them out, they could say that once more chips get in, we will send out the compensation units, which could take weeks and the comp units will be just as worth less as the originals! Also, the damn surprise, which was supposed to be released once mass shipment has begun still needs to be released."
+1000 the terms of the compensation are changed !!!!! BA what are you doing ? really not serious LOL I TOLD THIS ALONG TIME AGO..THEY GANNA TRY THIS,SHIP SOME SHIT OF PRODUCT AND GIVE US COMPENSATION "LATER"..OMG,THIS GUYS ARE IDIOTS..EVEN IF THEY SHIP IT,WE WOULD NEED TO PAY EXTRA TAXES AND OUR MINERS WILL NOT EARN EVEN FOR PAYINH THOSE TAX...BA = BUNCH of ASHOLES!!!

With the caveat that the 5 month delay is quite bad, and the sincere hope of at BARE MINIMUM 1:1 compensation...
At least there is finally clear evidence of mass production!

The compensation announcement is disappointing.
This looks like a legal move, in which they attempt to have customers "accept" the original purchase without their amendments. This, to safeguard against later claims.

Hopefully they will not compensate with a stupid coupon for our next purchase. But it looks it's now going in that direction...

Its probably what they will go with as it is in their best interest but totally worthless to us.

I agree - this is exactly what it looks like to me also.

Update: Minersource contacted me and said that I need to pay another $30 for shipping or get a refund based on a reduced amount of BTC because the exchange rate has changed. They said they don't even have the PSUs in stock despite listing them on their website as "in stock" over a month ago. I filed a complaint with the FTC and I am waiting for a response from Minersource. Anyone know which payment processing company they use, so I can contact them next? Minersource uses Bitpay. I thought this didn't sound like Minersource - and actually it looks like it was your mistake sir. The PSU's minersource is selling specifically state "FOR COMPENSATION UNITS ONLY". They are for customers who bought miners from minersource and these are add-ons to that order. Asking for more shipping checks out because they would ship for free with your order, but you don't have an existing order from them, so they won't ship free. I'm basing this on your previous post. I didn't place the original order with Minersource! I ordered before minersource was an affiliate and will receive my orders directly from BA. The only reason I ordered the PSUs from them is they listed them as "in stock" and are based in the US.
What do you say bobsag3? Are you going to ship my PSUs or issue a refund?
So. Contacting the FTC seems like overkill, don't you think so? Also they offered you a refund. If you paid what is it, $99, they offered to refund you $99. To pay you back the same amount in BTC they'd have to spend more than you send them to refund them. Getting the picture? Maybe they can refund you in store credit? I'd just accept the fact that there was a miscommunication and pay for the shipping. Perhaps minersource should have more clearly said they were ONLY for compensation units ordered from them but I for one thought that was reasonable to imply. Update: I don't know if this is new but it clearly says on the product page "No free shipping if not ordered from us."

Plus if you buy something and pay in full they can't come back to you and say you need to pay more because the exchange rate dropped just get the refund chap you don't need the psu any way if your getting a refund from BA

Just get a refund i don't see the issue. Sure they said it was instock but we all knew that wasn't the case and they should have converted it to fiat instantly if they were waiting on their supplier but since you are doing a refund from BA just take the refund. They accepted 0.8028 BTC under false pretenses for a product they do not even have. Why should they make money off the volatility in the BTC exchange rate? I should receive back the BTC I sent. They aren't making money. They converted your bitcoin directly to fiat and will now convert that fiat directly to bitcoin. Furthermore - minersource doesn't differentiate between "In Stock" and "Pre Order" in their store. Pre order items that are available for purchase say "In stock". Since they said "item ships for free with your current order" a reasonable person would assume these would get shipped when the miners get shipped. The x1 psus for instance are probably on their way with the miners. Seriously - calm down. You're falling out of your dress.

My miners are at BA and I ordered the now-useless compensation PSU from Minersource. I completely expect them to charge me shipping for it when the time comes to ship it because I did not have my units ordered with them.
I haven't asked for a refund because there is a part of me that is a sadist and wants Black Arrow to string me along some-more for fun while I believe that order might turn into something useful.

All BA is doing right now is maneuvering for a good legal position. They have probably examined previous lawsuits against mining companies and are using this information to build as defensible position as possible.
The majority of us will accept their shipments and they will use this fact to be off the hook for further compensation. Most likely this compensation will involve deferred payoff, such as coupons (so we can buy more frustration).
I do think the 50% compensation has a high chance of fruition as lots of us have paid (PSUs) for this already. This would take too much work to undo. The timing of this delivery will be another exercise in batch 1 disappointment.
BA management is trying to figure out how to position the company legally and financially for the post Batch 1 / 2 fiasco. How little they can compensate us and get away with it is the question of the day.
Yes, I am a frustrated customer. No more "Go Black Arrow" from me. I have yet to see any real communication from the very top that wasn't worded vaguely or conveyed any real concern.
Difficulty will be the salt in our wounds as the pre order model gives its last death rattle.

Wow if it was 2013, I would've guessed BA's X-3 beat out KNC's Neptune to the market if I was a betting man. So wrong about that: Pathetic....

But...But...There's no LCD, how will one ever configure it or know what they are running at? BA "produces" luxury machines that the average bitcoiner just wouldn't understand. Psh, it doesn't even come with a custom PSU, no wonder it got to market so quick.
Actually, the neptune comes with an LCD. =P

Now, what would be even more ironic is if Butterfly Lab's Monarch somehow makes a cameo appearance in someone's home before the X-3. Nah, that's some fairy tale shit.
