Delays

If the merchant is unable to ship within the promised time, it must notify you by mail, telephone, or email, give a revised shipping date and give you the chance to cancel for a full refund or accept the new shipping date. The merchant also must give you some way to exercise the cancellation option for free, for example, by supplying a prepaid reply card or staffing a toll-free telephone number.

    If you ignore the option notice, and the delay is 30 days or less, it's assumed that you accept the delay and are willing to wait for the merchandise.
    If you do not respond - and the delay is more than 30 days - the order must be canceled by the 30th day of the delay period and a full refund issued promptly.

If the merchant can't meet the revised shipping date, it must notify you again by mail, email or telephone and give you a new shipping date or cancel your order and give you a refund.

    The order will be canceled and a refund issued promptly unless you indicate by the revised shipping date that you are willing to wait.
    If you do not respond at all to the second notice, it's assumed that you are not willing to wait, and a full refund must be issued promptly.

Refunds

If you authorized a charge to your credit card account, the merchant must credit the account within one billing cycle - not give credit toward another purchase. If you pay by cash, check or money order, the merchant must mail you a refund within seven working days.

Once you can access it, it even asks your country.. I have sent them comments regarding the difficulty of access.

Note : I had difficulties accessing the website from outside the US and had to use a proxy plugin with firefox. (web proxies did not work for me.)

I had no luck with hidemyass and tried various other web based proxies with no luck.
Java was an issue and needed to be upgraded also.
I added one click proxy to firefox - and it looks good but I got disturbed by a call and have not completed. Its already late so I will try again tomorrow.


Is any other non US residents having issues with this. ?
Maybe this is why BFL has had such an easy ride ?

I can confirm that I was able to lodge my complaint with the above. Please persevere with this and get your complaint filed.

Regarding batch 1, I havn't had my refund yet.
Are you on the batch 1 list on the first page ?
What address ?
How many chips?
John dealt with batch 1 however mistakes can be made. Your the first B1 I have heard that has not received refund.

This is my order on the list.
I asked for a refund for my chips and already paid shipping costs on the 24th of september, and got a confirmation the next day from T13hydra that he added me to the 'to be refunded' list.
I have been waiting patiently after that, but still no refund.  Sad
I see you on the list for Batch 1 however on the block chain it shows your payment as 0.7 BTC

I have posted a topic on how to file a FTC complaint against BFL on their illegal behavior regarding late shipments and refusing refunds.

This takes less than 10 minutes and I encourage EVERYONE who has had problems with BFL to fill it out.  The more complaints filed the faster they will investigate them and put a stop to this nonsense.  If my above posts did not show that this is illegal behavior by BFL then follow my guide on the FTC web site and you will see that it indeed is a federal trade violation and they can get in massive trouble for this.  It's illegal and that's why you don't see other businesses behaving this way.

Should you still file if you payed in bitcoins?  How does this process work - how can you prove a bitcoin payment?  Show the blockchain transaction?
I payed my upgrade in BTC. It still shows it as USD on my Invoice and account page.  It IS a USD transaction.

I have tried with HideMyAss proxy and can now access the page.

I will try to file shortly and report back soon.

Ya, you're not going to have any luck. BFL owes me $30,000. They stopped responding to the BBB regarding my complaint, and I had to get the FTC involved and the AG's of both states (mine and theirs) . Still a work in progress, and no money. They tried shipping a rig anyways, and I sent it right back.

Good luck, don't get your hopes up.

+1000 This is exactly what everyone should do. They have little left to loose. BBB have initially rejected my claim, still trying to find out why and FTC site was down a few days ago however I will pursue this and I hope others will also.

It applies to all businesses. Just because a business is bitcoin related does not put it above the law.

I don't think so.  Too much hassle for what is worth.  I think they are too busy pushing the current gen products out of the door before they become completely worthless.  Nobody is ordering BFL products (with exception of Monarch), they are worth much less than their sticker price.

I'd worry about order cancellations.  I'd definitely not mine with customer products, I'd want to get rid of them asap before customers cancel them and ask for refunds.
