Well, I just had an interesting discussion with my Chase Visa regarding something I was disputing that I bought last January.
It was a similar situation as TH of non delivery of a product.
The lady said that they have 118 days (maybe 120, it was hard to understand sometimes) to dispute transaction.
BUT!
Those days start from the day you are supposed to receive the item!
So in my case I bought in January of 2013
On August 8th I got a reply to my ticket saying the item will ship.
Dead silence since then.
She started count of 118 days from August 8th + 1 week for shipping.

So I was just issued a credit a few minutes ago without any problems.

Now I just wish I paid TH with a CC and not a wire.

Ive got respose today from Steve.

Just to be clear. Ive voted for "stay" (not refund). But steve did not react on my PM, nor gave me any info about what he was doing with my money..

In todays PM he stated that he has already bought KnCs and will give me hashing power or refund me from profit generated by KnC.
Besides the obvious fact, that he did not ask if I want to go for KnC - I am not sure if KnC will deliver.
Some guys on e-btc were talking about KnC delivery and acording to them KnC is delivering 1of8.

Ive asked Steve for a copy of the order (invoice). Since he used my money for it I thing that thats within my rights..
Without trawling the thread, i was of the understanding that whatever you voted for, it went with the majority i.e. over 50% voted for refund, so we all get refunded. I didn't vote as I was happy to go with the majority.

So if you voted not for refund steve gets to play with the money ? I think this is an abuse of the group buy and escrow.

Of course those who bought from the website were not truly escrow'd in the first place. Although Steve stated that web orders where when I asked.

I hope more people come forward so we can get a scale of how much is it play here. Am out of town for a week or so, but will try to keep an eye on the thread whilst away.

I am taking BFL to court this week in Pennsylvania, also suing for treble damages since they knowingly violated the law and the FTC guidelines in not honoring refunds when requested after delays as well as the Pennsylvania Consumer Protection Law If anyone has any horror stories or if anyone would like to make any statements for me in court that would be awesome, i'll update this thread once everything is processed.  Has anyone else taken ButterflyLabs to court?  If not im very surprised, seems like an easy win to me.

Shame we don't have more time. A petition from all who where denied a refund from BFL would have been nice to take into court with you.

If someone could draft something up we could get a quick wip round and drum up a small list.

If anyone could knock up a good webform please do so (am not so good with things like that).

Ionstorm, if someone does this would you be prepared to print it and add it to your evidence ?

Neither did he dispute any of my accusations, he just locked the thread.
I was hoping he would give some reasonable explanations.
Refunds seem to have been on a he who shouts loudest basis.

Although I guess most have been refunded as this has been pretty quiet here.

Time will tell, I do not see much future in further Investment based on performance so far thou.

If you need further funds from people to repay passed investors then some call it a ponzi scheme. Those future Investors can see a portion of there Investment go to previous. Does not sound like a plan to me..

The customs form ask's for the value of the Item. BFL will state the purchase price, this is no longer the value of the item. A lie.

I've had cases opened at DME. The baggage handlers go through them looking for whatever. With mine they couldn't be bothered to zip the bag up. Security then put some tape around the bag to stop the contents falling out too much hassle to zip it. Its likely the same happened but security where more kind to you than me a re-zipped the bag for you. In the process anything small could of fallen out.

I actually assumed that a thread like this would be started. Closing a thread with so many people still hanging was probably not the best thing to do or really very fair, and unless this professionalism materializes that was written bout in Steve's last post one can only assume that his true intention was to "bury" it as much as possible.

I've tried to remain as positive as possible, but I'm just really dissapointed by how this has turned out.

With Blades now at 0.8 per 10G/H it really must be time for bitfurry to reduce chip prices and meet the market. If barntech is up for it and bitfury plays ball there is a good opportunity here for a couple of speedy batches@ discount. I would much prefer more drillbits than blades but hayho.

Am glad to see he is still refunding.

I started this thread, as I feel until all refunds are resolved the thread should not have been locked.

I really have no Idea how many members are waiting for refunds and feel they need somewhere to gather.

If it turns out to be more than a few, and members would like it,

I will keep the first post updated with a list of outstanding debts, but only if requested.
