Well that settles that. They clearly stated that the guaranteed delivery date was 12/31.

This is HF's puppet. This puppet is still confident that they will deliver by the end of the year. I hope the puppet to be wrong.

It's not about betting ckolivas, it's just that you are one of their best resources on making the miners to mine as efficiently as possible, and in my irrespectable opinion, the fact that they don't have provided you with a real world device to do your optimisations tells that they don't have any. Hopefully, this will keep true until when we can get a full refund from this "startup" of liars and defrauders.

HF_CL, as it was repeated to death, the first half of your batch 1 customers didn't have such a date on their contract, and your website promised an October delivery. The wording was later changed to anticipated and you added your criminal "deadline" on your ToS. You denied the refunds i requested after that, and it was another criminal action on it's own.
I understand that our future legal actions will be based on you denying that you promised to delivery in October, but denying it won't make life anyway easier for you.

To be specific, 31 of Dec wasn't the guaranteed delivery date, it was only the date after which you guaranteed your customers a refund.

But where is that point? And what does refund in the currency you paid means? Where do you read that it would be the same amount of bitcoins and not a lower amount for the same USD value?

I remember the posts from the ceo, it was misleading at least if they won't refund the same amount of btc you paid, but it has been discussed to death, they are never gonna do that by their own will.

this is what the original TOS did say: delivered by 31 Dec. I never really believed on their date of deliver by 30 Oct but I did also not expect this late date in Dec.
I was talking about the points that you claimed to define how the refunds where issued...

Well, i guess than in this case i'm just a bastard with money to throw away on lawyers over a question of principles. I really fell like there are several "foundations" to act against them.
On the other side, would you mind to point out the terms you are talking about in the original contract? I can't find them. Thanks.

Saying to be shipping on a saturday just before christmas could be just another way to buy time - to leave you unprepared when they will delay after their own criminal deadline.

I think that for now, for my order, i will do 50/50 if they delay after the new year. I will keep half of the miners and demand a BTC refund for the second half, with the lawyer already ready when they will deny that in favour of USD refunds.

The deadline is really just behind the corner...

I think that you could use an usb adapter (sata to usb). You could also create a raid 1 over 2 usb sticks. Another opinion would be to create a sierra like setup, where the boards are directly connected to an external server (chaining as described in the protocol).

@bitcoinermax, i've already replied to these points several times. It's not a startup. They have our money, they stole them, and they have some valuable assets. Sorry but i don't have the will to further explain this.

Not gonna happen, they kept pushing on the "before next year" shipping date since the delay. They will have to find alternative excuses for the delay after November, tough

For what it matters, john at the time said that it was natural that he offered me to switch to the sierra case, and that he had accepted every similar request from every other customer that asked... This is why i never tough of this as a one time basis thing, and never had a problem sharing it with everyone, when i tough HF to be legit...

It not true, many datacenters accept as little as a 1U, you have 4U (the BJ case should anyway account for 4 units of space, anyway, some low level datacenters accepts case units and not only servers), for a sigle BJ, the best option could simply be to run it off your home power outlet.
