My invoice says "HashFast Technologies, Inc. (“Hashfast”) 97 South Second Street #175 San Jose, 95113 United States".
I will never have nothing to do with HashFast LLC, i suppose.

You seem to have done a lot of paperwork. Any interesting conclusion you would like to share? Thanks.

You will have to deal with "HashFast Technologies LCC".

http://kepler.sos.ca.gov/

I am surprised they declared to be an incorporated entity in the invoice.

Note that while I'm writing software for them I'm just a contractor so I have no direct allegiance with them, so I'm trying to sift through all this information and I want to know if anyone has kept a copy, screenshot or whatever, to show that they promised to deliver by October 30th? I certainly remember it being implied when I first looked but wasn't really watching early on to see what was being advertised.

Hi Con!

Thank you for all the work you're doing to ensure cgminer works flawlessly with HashFast ASICs.

Per our ToS, Dec 31 is the guaranteed delivery date for Batch One.

Best,

-HF_CL

“We can say without equivocation that firms like MasterCard, Visa and the TBTF banks like JPMorgan and Goldman hate the idea of ever having to compete for business again. They have grown comfortable in their corrupt world of writing laws for themselves without any regulatory oversight. They enjoy the exorbitant privilege of bilking the American economy with extortionary transaction rates. They are scared of Bitcoin. And they should be. It offers transparency, cost efficiency and anonymity.” - Max Kaiser

*troll attempt detected* (i hope that they paid you already, ckolivas).

HF_CL, as it was repeated to death, the first half of your batch 1 customers didn't have such a date on their contract, and your website promised an October delivery. The wording was later changed to anticipated and you added your criminal "deadline" on your ToS. You denied the refunds i requested after that, and it was another criminal action on it's own.
I understand that our future legal actions will be based on you denying that you promised to delivery in October, but denying it won't make life anyway easier for you.

To be specific, 31 of Dec wasn't the guaranteed delivery date, it was only the date after which you guaranteed your customers a refund.

I guess I would just have to say that even though we are getting screwed that they did get an impressive amount of money for a company that is just about to be 6 months old or so... (meaning that they may not even have a D&B record yet as they usually take about 6 months before the company is listed with them)

True, but there is already an Experian Credit Report of "HASHFAST TECHNOLOGIES LLC":

I was trolling about your salary ckolivas, but i admit that i exulted when you said that you have never received a populated board. Thanks.

Archive.org about the delivery date that HF_CL claims to be in December:

Our products are high-performance ASICs. Our first chip, the Golden Nonce (GN) microprocessor, is in the final stages of development. The GN will ‘tape-out’ and be sent to manufacturing in August. Fabrication will take a little bit over two months, and the chips will ship to customers in October.

(You won't be able to take that page down easily).

I'm neutral and very open about getting paid and what I'm doing. I'm even happy to disclose my fees if people want to ask, and I charge a lot less for free software work. As I said about 100 pages back, me getting a board doesn't count as the company delivering to customers for betting purposes either since I'm a contractor. The most I've had is (fpga) emulation hardware so far, though I have every reason to believe it will be real hardware by next week.

It's not about betting ckolivas, it's just that you are one of their best resources on making the miners to mine as efficiently as possible, and in my irrespectable opinion, the fact that they don't have provided you with a real world device to do your optimisations tells that they don't have any. Hopefully, this will keep true until when we can get a full refund from this "startup" of liars and defrauders.
Thanks for your openness, i really appreciate it.

Well that settles that.  They clearly stated that they expected to ship in October yet, as we know now, Hashfast never had any ability or serious intent to do so. That's called fraud.

That's just not true.  BabyJets were put on sale on Aug. 9th.  Prior to roughly the 14th of August there was no mention what so ever of Dec. 31st and the only dates advertised were "Oct. 20 - 30"  on the 9th and 10th 147 BabyJets were sold.  It wasn't until that large portion of batch one was sold that they said anything about Dec. 31st being the "guaranteed" date.  The above screenshot clearly lists the order date as being in September well after early August when all the mischief happened.

Are you still on schedule for Oct shipping ?

Yes - mock tapeout went very well, and yes we are on schedule.

-John

you don't say?

and what about all that slander from Amy against KNC just before they were delivering??  Probably a whole bunch of smoke in those words as well

I'm not sure that the posted image qualifies as "clearly stating". It's actually the opposite - there are two delivery dates with a 2 month delta almost next to each other. I'd call that ambigious or unclear.

That might be your ToS, but this one is mine: http://pastebin.com/EfS9vmRf

This is the announcement post on bitcoin talk: https://bitcointalk.org/index.php?topic=270384.0

This is a screenshot of the product page at the time of my order: https://i.imgur.com/DDessZJ.png

This is my order confirmation: https://i.imgur.com/mHjIYzy.png

There was no ambiguity in the published statement "Shipments begin October 20-30"

The original ToS did contain the following paragraph:

Quote
Except for delivery dates explicitly guaranteed in the order confirmation, delivery dates communicated or acknowledged by Hashfast are approximate only, and Hashfast shall not be liable for, nor shall Hashfast be in breach of its obligations to Buyer because of any delivery made within a reasonable time before or after the stated delivery date.

However a 'guaranteed delivery' date was not present, leaving it open to interpretation as to what 'reasonable time' means in the context of mining hardware purchases. 7 days after my purchase I received a 2nd 'order confirmation' by email with updated boilerplate:

Quote
Your order is expected to ship between October 20 and October 30, 2013.  Physical delivery of your order will take place within days, depending on the shipment method selected.  HashFast guarantees that all "Baby Jet" units from our first production batch will be delivered by December 31, 2013.  If Buyer ordered one or more Baby Jet units, and HashFast does not deliver such units by that date, then Buyer may at his or her discretion, cancel the undelivered portion and HashFast will issue a full refund the payment for the units that Buyer purchased but did not receive and cancelled.   This cancellation and refund is Buyer's sole and exclusive remedy for HashFast failing to deliver by the December 31, 2013 guaranteed delivery date.  Buyer must cancel the order and request a refund by January 15, 2014 to avail him or herself of this remedy. Buyer to pay all taxes, duties and shipping costs on units delivered.

Also they had updated their ToS by that date (Aug 15) to include the guaranteed date (However they kept the revision the same at '1.B – Revised August 8, 2013', and now appear to have dropped revision number all together in their ToS so it is hard to know which one you are bound to unless you save a copy at the date of the sale).
