if it will happen we have no foundation to act against them. Well, i guess than in this case i'm just a bastard with money to throw away on lawyers over a question of principles. I really fell like there are several "foundations" to act against them. On the other side, would you mind to point out the terms you are talking about in the original contract? I can't find them. Thanks.

Why are you saying they aren't shipping in time? Last official word was shipping this saturday (21st). For americans, shipments to the USA from canada using UPS next day should generally arrive next day.
when did they say this?

Saying to be shipping on a saturday just before christmas could be just another way to buy time - to leave you unprepared when they will delay after their own criminal deadline.
I think that for now, for my order, i will do 50/50 if they delay after the new year. I will keep half of the miners and demand a BTC refund for the second half, with the lawyer already ready when they will deny that in favour of USD refunds.
The deadline is really just behind the corner...
we need a US based lawyer. he has to be familiar with the Bitcoin business.

I was talking about the points that you claimed to define how the refunds where issued... refund in the currency you paid. have to check the original TOS again but I remember it was in the TOS.

I remember the posts from the ceo, it was misleading at least if they won't refund the same amount of btc you paid, but it has been discussed to death, they are never gonna do that by their own will.

My invoice says "HashFast Technologies, Inc. (“Hashfast”) 97 South Second Street #175 San Jose, 95113 United States". I will never have nothing to do with HashFast LLC, i suppose.
You seem to have done a lot of paperwork. Any interesting conclusion you would like to share? Thanks.

Some states have that information indexed by google so it's easier to find, some don't. All the same it's public data and it can be found, maybe D&B would have some other information... I guess I would just have to say that even though we are getting screwed that they did get an impressive amount of money for a company that is just about to be 6 months old or so... (meaning that they may not even have a D&B record yet as they usually take about 6 months before the company is listed with them)

Many people base their corporation out of Delaware because of favorable laws there-there's also no corporate tax. Even if they're an LLC (which doesn't pay corporate taxes anyway) they might wish to change their corporate structure someday. That's why you'll notice that all the banks are based out of Delaware even though they're not headquartered there in reality.

This Startup lied to their customers and game them a false date of October to get the necessary money to start their company. Note that while I'm writing software for them I'm just a contractor so I have no direct allegiance with them, so I'm trying to sift through all this information and I want to know if anyone has kept a copy, screenshot or whatever, to show that they promised to deliver by October 30th? I certainly remember it being implied when I first looked but wasn't really watching early on to see what was being advertised.
