And about what Bruno is doing, if you want to prove something, i hope that you are saving good proofs of it (eg email headers as you said, archive.org or at least screenshoots, etc).

Also I'd like to avoid being used as tool again. Last time John gave me verbal confirmation that full BTC refunds would be given in the amount paid and that I was allowed to post that on bitcointalk (which I did). Turns out it was misinformation and made me look like a fool.

And they never denied this.
They were sure to be safe with their own criminal deadline, and they promised things they don't want to do. That's what the law is for.

Even Josh here (i'm feeding the troll, i know and i'm sorry) will agree with me that BFL would have acted in a somehow smarter way. HF was this far from the perfect scam. We got lucky. Or maybe someone saved us.

By accepting arbitration, I believe you accept those Terms of Sale as valid and enforceable. Hashfast had absolutely no Terms of Sale a buyer could read back in August when I purchased. I remember looking everywhere for them. None Existed.

I saved a copy on day 1 (August 8 ) and emailed it to myself so it is time stamped by gmail. I've also uploaded it to pastebin in September here: http://pastebin.com/EfS9vmRf

I dont know if the market can bare another pre-order asic company. Unless you have plans to sell before sep/oct i dont think you'll find many buyers. Good luck.

It isn't. First, it needs be established whether that clause is valid and what circumstances it covers. It is not legal to put a clause in a contract that says "you can't sue me". You can always sue. And if it is the case that HashFast is guilty of fraud, that is not going to be settled under arbitration but by a real court.
Arbitration is faster, cheaper and binding. Standing to my lawyer, it applies the word of the law as good as a court of law. If the guy i was replying to decided to go to (binding) arbitration, he couldn't have a second possibility.
Please correct me if wrong.

What do you mean by "i might just try"? It's you only legal recurse, and your only possibility. It's not a try, it's the only try.
(this if you don't plan them breaching any law in the penal code, sure, that could as well be the case; at that point arbitration wouldn't fit in anymore).

looks like they ignore all refund request according their former TOS versions. but this is not important. we agreed to the initial TOS. nothing else. don't hit the trap with the new refund contract!

It is important because we all have to get ready to proceed against them legally. As i keep saying from months, a simple treat won't do it. Especially with Eduardo something DeCastro

That's in the case ninjarobot didn't received a confirmation email saying that their order was guaranteed to ship by the 31 of Dec. HF has been emailing customers that ordered during the previous ToS with a new, updated version.
