They don't delay them, they simply use them for the normal BJ orders.
HF started shipping in mass 25 days ago. As far as we know they shipped Batch 1 (600 boards) + pre-retail + something of batch 2 (looks like that icedrill received "nothing", right?). Around 50 boards per day. It's quite a low number, they are no where near where they should be with the scalable supply chain that they promised us. So i really wouldn't say that they are simply using the boards to satisfy other customers, rather, they are doing whatever pleases them the most, because they can. The deadline for the legal route of batch 2 was two days ago. I guess that no one went on, right? So why should they care about shipping on time?

It still doesn't make sense in any way you try to read it. You don't delay a money printing machine because you miss a fancy control panel. A cooling system isn't anything that can't be bought on a well furnished local shop.
I guess that they will have to find better excuses in front of an arbitrator.

Did anyone actually successfully set up arbitration with them? Setting up an arbitration with them is a really simple process, that can be done online as well in the case of AAA. That's not the problem. The problem is that they will continue to ignore you as well, even if you enter in a binding arbitration with them. By the time that the arbitrator gets you your award, they will probably have closed shop or something. This is why i love how Morici's lawsuit calls them in as individually responsable, and not only for the LLC companies.
