So, I know how easily this thread could possibly turn into a conspiracy thread where people accuse the mods/admins of all sorts of BS. I would like to ask that nobody turn this thread into this. Essentially, I feel like some mods/admins (in this example, theymos) are being very unfair in scammer tag judgements. In the Andrew Bitcoiner thread ( https://bitcointalk.org/index.php?topic=143980.0), there are many accredited people in the Bitcoin community who have come forward and said that Andrew has scammed them. Theymos even implicitly agreed that the funds were stolen, yet he claims that since he didn't explicitly say that he couldn't steal out Bitcoins, that he's in the green. By this logic, I could scam EVERYONE in this forum and not get a scammer tag. Simply because I didn't say that I couldn't in the contract! By this logic, every scammer is not actually a scammer. Pirate is all cool, since he didn't ACTUALLY steal our Bitcoins... We didn't say he couldn't! The difficulty with this case, IIRC, is that Andrew Bitcoiner's sites had terms which said that he could do whatever he wanted with deposited bitcoins. I might be willing to give him a scammer tag despite this, but this fact really strengthens his case, especially since not all users are affected.
There has never been a Terms of Service on his website (bitjack21). I don't understand where he came up with this. On the rules page, it says that the ToS is located at https://bitjack21.com/tos.php, but it's a 404! And then, my main point: Even though he doesn't defend himself, I don't feel like the situation is clear enough for a scammer tag. Mostly because this is an external site with unclear status and agreements. I can't find a provable instance of him actually breaking any agreements.
He's essentially saying here that JUST BECAUSE he didn't agree that he wouldn't steal our BTC, he's allowed to. One would think this was implied! I am not asking that theymos be kicked out of the forum or anything (because he owns it, iirc), but I would like to have a civilized (read: NO THROWING AROUND ACCUSATIONS) discussion about how the forum is to hand out scammer tags. I fully accept that this forum is essentially a monarchy, and therefore theymos's decision is final, but I would think that the forum would want to make more fair judgements than this.

I'm not really sure where you saw that he can do whatever he wants with deposited btc. Can you point me to where it says that on the site? Also, think of it like this: A person sells an iPhone for 20 btc, and the buyer pays him. However, since the person with the iPhone didn't EXPLICITLY say that he couldn't scam you, he doesn't get a scammer tag. That's pretty much what you're saying here. Does this mean that if I run a HYIP, but I don't say that I can't run away with your BTC, that I won't get a scammer tag when I do? Sound familiar???

Have you read their ToS? Ya know, the actual CONTRACT THAT YOU WENT INTO WITH THEM? I'm sure they disclaim responsibility for this sort of thing, since, you know, they don't want HIGH RISK PURCHASES? And, do you know that every financial services provider ever does this? I love how every time one of these comes up everyone chimes in on how they are being sold for money, but they aren't worth anything. If this is such a bad deal it will take care of itself after no one replies. Why does everyone feel the need to be a classified ad critic here? It is counterproductive to a positive selling atmosphere and a sign of far too much free time.

I don't recommend doing this, but I could write a script that let's you send a certain number of text messages to a person from a computer. I will not, however, make a text message bomb script. If you know what I mean . Do you know what carrier his phone is on?

It doesn't look like you're putting any of your own money into the game, which means that you have almost no personal incentive to go through with this! 2. Why would someone invest in a game that is upgrading someone else's (probably) COPYRIGHTED game? It's not a new idea, it's just "I'll steal this game's idea and add invincibility!!!!!111oneone111!!!" 3. Why do you need $5000? ? This sounds like a really, REALLY simple game that would take a very minimal amount to develop! You also mentioned "keeping the site up." IMO, you're not going to get millions of visitors on the first day of release, so I think you can get away with a VPS (at least until you get a good user-base!). 1. For example COD is remade everyyear yet it keeps selling because they make minor changes. 3.I have talked to many people and companies about my game and 5k is just about where they all say it would cost to make. Prior to the game launching I need to have servers to do login authentication, hosting lobbies, matching up players. There are many things that going into it. Yes the site I could most likly run with just a VPS to start but I would much rather have a full fledged server going then have to upgrade the server when it crashes. 1. How much of your own will you be putting in? 2. Yes, every game copying another game is a copy. And COD has a different story each time, AND they own the copyright! You don't OWN the copyright to the original game, so you don't have the right to remake it. 3. Who have you talked to?

A theory by someone in the other thread was that it's because he's not affecting any of the mod's, so they don't care (I don't necessarily agree with this, just saying what the other guy said). Also, I hate to be a pessimist, but a scammer tag won't do much. Too little people do research before giving people Bitcoins.
