(j) REFUNDS. Any refunds due to Buyer will be made in United States Dollars, and for the purposes of calculating refunds, amounts paid in Bitcoin or other virtual currencies will be deemed paid in United States Dollars at the exchange rate given by Hashfast to its customers on the order date. Refunds for partial order cancelations or returns will be adjusted for any discounts previously given to Buyer for volume purchases.

WHAT DID YOU JUST SAY? For what any other reason would you put that term about refunds if you where on schedule? They won't delivery by the end of the year, and they won't give you BTC refunds, even if they promised so. And don't call me hater, please. I'm just trying to open some blinded eyes. (BTW, i think i will ask for a refund when they fail to deliver). (BTW2, here is your lovely substrate news, it arrived, in form of a ToS upgrade!)

What I found really interesting is they removed the line about the exchange rate for late payments that went in their favor and added the USD only refund when it's in the customers favor.
The old version is still in google cache if anyone wants to save it.

Here is my personal updated ToS for HF: If Buyer incurs mining losses due to Seller’s failure to deliver when deliveries are due, Buyer shall be entitled to equivalent compensation from Seller for such losses.
Stop f*cking your customers HF.

But if the other option of sending BTC directly is used, there is no reason why they shouldn't give back the same amount of coin. That ventures into legal territory IMO if they hold onto coins and give less back. It totally rigs the game in their favor.

Hashfast shall have no obligations for breach of warranty if the alleged defect or non-conformance is found to have occurred as a result of operation in an ambient temperature other than 5-22 degrees Celsius (40-72 degrees Fahrenheit) Better not mine during summertime! Did they just say "warranty void if ambient temp goes over 22c"?

Biggest mistake to buy Hashfast products while they change TOS anytime they want, why ship on a deadline? when they can just change the TOS and say we will mine with your hardware and ship after March 31 2014. Why would they ship out MMP? when they can just change the TOS?

they stated originally they would be giving us weekly updates. I'm curious if they got the substrate that was supposed to come in today and maybe any news on an estimate for a shipment date. Shoot the messenger all you like. It won't change these basic facts: Fact: HashFast's last "weekly" update was much less than a week ago. Fact: You nevertheless whine about lack of updates. Fact: You are not entitled to daily updates. You should get a life, stop being so high maintenance, and give them a chance to finish our hardware.

If buyer has to follow the updated ToS, and buyer disagree then in my opinion buyer should have right to get refunds.

The terms of sale are those posted at the date of the sale. Subsequent changes apply to subsequent purchases. Point being: The TOS applicable to your purchase is the TOS at the time of your purchase.
In my case there was one TOS on the website on my day of purchase, and another appended to my order confirmation.
They can't change the terms of sale after the fact.
Present estimated Hashfast fraud score for 1st batch customers (by Hanlon's Razor):

Still doesn't mean that they can't make up for it all... if they decide to.
As to the 72 degree ambient temperature bullshit... BWAHH!

This is why HF added the following: ENTIRE AGREEMENT; SEVERABILITY. These Terms, together with the order confirmation(s) sent from Hashfast to Buyer, are the entire agreement between Buyer and Hashfast with respect to its subject matter and supersedes all prior oral and written understandings, communications, or agreements between Buyer and Hashfast. No agreement is made between Buyer and any Affiliate. Hashfast may revise, update, or otherwise amend these Terms but posting such amended Terms on its website or otherwise providing such amended Terms (e.g. by email), and such amended Terms will govern Buyer’s purchases if accepted by Buyer in any of the ways specified in Section 1.
I'm not sure when this was added exactly, but for sure it was not present in the original early August ToS.

HashFast is very busy assembling the first batch of true 3rd gen Bitcoin mining hardware. These miners are not intended for home use. In other words, commercial use only. They aren't set-top boxes or your Playstation. They need to be hosted in a temperature controlled environment, not your basement/garage/attic. "Unreasonable" is expecting heavy-duty professional grade hardware to run reliably in an ad hoc amateur setup. "Unreasonable" is buying a supercharged Cadillac XLR because you want the high-compression 443 hp engine, then whining because it only takes premium gas.
