If you email CIARA, they put you in touch with John, so it's not like they "can't" be reached--I think jjiimm is probably right, or they just truly don't give a flying fuck.

I also wish HF would be willing to meet their their Batch 1 customers in the middle and work something out. For example, if HF could guarantee to deliver the ordered units + 4 MPP boards before the end of January, I would accept it. Personally, I don't think this is an outrageous request as the original unit was supposed to ship in October of last year and the 90 day MPP window ends in 8 days. In other words, I'm willing to take a 50%+ loss and accept what I ordered even though the original unit is 3 months late. However, the ball has been in HashFast's court for a long time now and they are not playing. We know nothing apart from the occasional hostile ToS change, release form or unsolicited refund. The clock is ticking, and I can not wait forever. Is it too much to ask a company to work *with* their customers instead of against them?

I doubt he's been bribed by HF. EDIT : Edited a violent post, another bad evening, sorry. But seeing people trying get full refunds, hoping others get nothing in exchange, disgusts me. And attempts to stall people who actually fight by saying "it's risky! They could hit bankruptcy!" are getting on my nerves.

KnC: Summer ended Sept 21, delivered mid Oct. Lets say 3 weeks late. HashFast: "Ships Oct 20-30", still hasn't delivered mid January. Lets say 3 months late and counting. "Hashfast is less late than KnC is." Wow. No wonder BFL is always late. You don't understand the difference between days, weeks, and months! He has financial interests in spreading FUD about KNC and using the HF scam as a shield to defend the scam he's involved in at BFL.

HF will have to give him his BTC back. It's only a matter of when. They could do it silently and offer him an extra by making him to sign an NDA for that, and it would make a lot of sense.

One question that i would like to ask your friend: Given the precondition that they have sorted out their problems and producing now full scale. Whats the legal situation if they decided to force refunds all of their customers just to either mine themselves with those miners or to sell them again at higher prices in their webshop? Good question. It very much depends on why they are refunding you. If they say, honestly, that they cannot guarantee a delivery date due to technical problems, then they're in the clear. However, if they ship to other customers the following week, then that reason could clearly be challenged, but you have to realise that this is commercial litigation, not criminal, and on both sides of the Atlantic it can take ages, and cost a lot to prosecute. (Just a thought, by the way for US buyers - thought about applying for a slot on 'Judge Judy'? It's not as stupid a suggestion as you might think, and I'm sure the networks would love it. Only problem is that the maximum you can sue for is $5000, and the other party has to agree to appear. But think of the publicity! Not sure if someone from, say Germany or the UK could apply to sue a US company?) As for them hashing with 'your' equipment, I have discussed this at some length with my QC friend, and he is of the opinion that it would be nigh on impossible to prove that Hashfast were mining at all without 'inside knowledge', ie Bitcoin Wallet addresses, IP addresses and the like, and even if you could prove they were mining they might claim they were using other equipment. He thinks your chances of success in a legal battle are near zero - a judge would have great difficulty even understanding the concepts, as would a jury and there are too many variables in the arguments. Again I'm sorry to bear bad news, but it's best to be realistic. And speaking of being realistic, have the Hashfast buyers thought of puting together a 'fighting fund' for their cause? If you could elect someone that you all felt you could trust to represent you to Hashfast - not a lawyer - then they might talk to that person rather than trying to fight on hundreds of different fronts....and you'd pay the person for their travel/time etc. I'm sure there is someone among you who could fit the bil. Despite the negative comments, I still think Josh is your best bet, purely and simply because Hashfast know he's in a senior position in his company and has already expressed very unbiased views concerning the situation - he could just as easily have slated them, but he didn't and I think any reasonable person would recognise that this was a very fair and mature position to adopt. I don't know him and know little about him, but anyone that doesn't jump on a bandwagon to get one over on a competitor deserves my respect. I'm also guessing that despite BFL's early problems, an awful lot of people made an awful lot of money from mining with their chips. Just an observation. I do think Hashfast would talk to him as they would have an 'audience' that wasn't going into a discussion with a prejudicial attitude, and ultimately, he's on a similar seniority level. Put it this way, if you thought he could get a solution - even if you think he's the devil incarnate - would you agree for him to represent you?

you realize right Sweden summer is at a different time of year then USA right. Hum, solstices and equinoxes happen at the same time everywhere and mark the start of the same season for every place in the same hemisphere... Last time I looked the USA and Sweden were both north of the equator. Did one of them happen to travel to the south?

Thats why it was a brisk 20 degrees in Fukushima Japan on March 11, 2011 and it was called Winter locally. Yet in the USA it was a warm 70 to 85. You didn't realize it was still winter over there....until you heard all of the reports of people "freezing" due to all their Japanese reactors going offline in the middle of pretty cold weather. I got this from wikipedia In Sweden and Finland, meteorologists use a definition for the seasons based on the temperature. Spring begins when the daily averaged temperature permanently rises above 0°C, summer begins when the temperature permanently rises above +10°C, summer ends when the temperature permanently falls below +10°C and winter begins when the temperature permanently falls below 0°C. "Permanently" here means that the daily averaged temperature has remained above or below the limit for seven consecutive days. This implies two things: first, the seasons do not begin at fixed dates but must be determined by observation and are known only after the fact; and second, a new season begins at different dates in different parts of the country. so it would be entirely possible to have a different summer dates to the US
