Small claims court information:

http://www.nolo.com/legal-encyclopedia/free-books/small-claims-book/chapter9-2.html

PA has a $12,000 monetary limit in small claims court, meaning that is the maximum you can be awarded if you win. This leaves anyone that has pre-ordered more than 2 miners, out of luck.

Only for small claims. Not for civil or criminal complaints in regular court.

When we place a pre-order agree with the conditions and BA say very clear from the day one "whe use the money of your order to produce the miners so... no refunds" and "delays can happens" (more or less). You can ask nicely for a refund but is not your right.

That is not how it works. They have to communicate any delays, operate on a definite timeline, and if the delays are excessive (which usually is taken as two weeks by most US courts), they have to offer a refund. TOS only supersedes law if it's MORE restrictive on the vendor.

This is not new information. I'm not a lawyer, so I've no clue how they might be able to wiggle, but the basic principle is solid, and I'm not guessing.

Oki dokie.
i was fuckin stoned and i did'nt understand what they were saying stupid retards !! thanks Biomech for the reply !

Lucky you! I ain't been stoned in so long I don't know what it feels like anymore Sad

Banter aside, I hate how newbies get jumped here. Granted, some have it coming, but the "old boys club" mentality just ain't gonna get it. Bitcoin is going mainstream. It ain't there yet, but it's getting there. A year ago, a few people were aware of it. Now it's front page news even in Boise, Idaho, where the newspaper has made a century long career out of being behind the times.

We desperately need new people, and jumping somebody just for being new is stupid. In nature, Stupidity is a capital crime. Judgment is immediate, utterly impartial, and there is no appeal. In modern society we have made a religion out of protecting the stupid. Since stupid is ALWAYS a choice, that religion is not only false, it's fatal.

How long does 1 block take for payout? Is it about 45 minutes, 30 minutes, or 15minutes???
Well, that's the 25 BTC question, isn't it?

Depends heavily on luck. I've seen the pool do two blocks back to back in really short time, and I've seen it take several hours. Usually it's pretty quick, as Eligius has ~ 20 percent of the network.
2506  Bitcoin / Hardware / Re: Official Thread: AMT on: March 07, 2014, 07:03:05 AM
I never did get a confirmation from IMET if they were one of AMT's pcb manufacturers, but I'll take the geotagged picture as confirmation.

I did get a lovely response to an email I sent today.

Hello,

Order #1432 here aka **** Shaffer. I was just wondering if there were any updates on production of the miners. I did see a e-mail supposedly from one of your accounting people that there are still parts of the miner that are not yet invented. Is this the case? If so is there a revised timeline on the orders as I'm anticipating shipment no later than march 31st which your website still advertises.

If delays are going to occur will we be compensated with a 2.4 the miner if ROI is not attainable with the 1.2th units as per your Miner Protection Plan?

If you have indeed shipped units what order number have you shipped through. Any information you have would be valuable. If you were to update your news section with each lot of miners shipped it, it would help ease worry about your ability to get the miners assembled. Currently many people think you are scamming but, I'm not of them. A little  information in good faith would go a long way towards easing fears. I know you have everyone and their brother pulled for miner assembly, but if you could have someone, anyone, perhaps someone with no arms incapable of assembling the miners manning the phone it would be appreciated.

I've left multiple legitimate messages on the phone each time with the voicemail insuring me of a prompt response within 24 hours.

Jim's response:

Curt,

Production is running smoothly and we are shipping. We have yet to find the time for updates and forum is just a world of lies. Everything is fine and your is on track.

All the best
jim

So incase you were wondering we are a WORLD OF LIES. And though there are those of us on either side of the debate we are all seemed to be lumped together as liars.

So stop lying to me guys, everything is running smoothly and the ARE shipping.

This pisses me off even more. I ain't lied once. To you guys OR to AMT.
2507  Bitcoin / Hardware / Re: Official Thread: AMT on: March 07, 2014, 07:00:11 AM
Ok... here are the instructions on taking AMT to court:

You may file with a District Justice if you
have a complaint against a person or a store
and wish to recover money totaling less than
$8,000. This limit excludes the cost of the suit
itself; if you win you are entitled to
reimbursement for court cost.

SELECTING DISTRICT COURT
For assistance in finding the correct court, you
can call (610) 565-6990 or (610) 891-4865.

file a complaint on a form, which
you can obtain at the District Court office.
Your name and address.
 Business name and address.
Amount for which you are suing.
A short statement of why you believe you
are entitled to the money. Be sure to
provide enough information so that the
person you are suing knows why they are
being sued.

Suits from $4001.00 to $8000.00 – $117.50
Once you have filed the complaint you will
receive a hearing date in the mail. The date
must be between 10 and 60 days from the
date you filed. The law requires that before
the hearing, the other party must receive a
copy of your complaint. This can be done in
two ways:
1. Request that the complaint be sent by
certified mail.
2. Request that a Constable hand deliver
the complaint. There is an additional charge,
but if you win, these costs can be reimbursed
.

In short,  have the police deliver the complaint.

Constables in the Commonwealth are not exactly police. They have many of the powers and duties of regular police, but they are primarily officers of the court.

Not to put too fine a point on it, they are the Magistrate's personal goon squad, and they are mercenaries. You probably DO want to use them.

PA's law system is just plain weird. Magistrate is an elective judge, and his powers are pretty intense. I would advise any of you who go before a magistrate in PA to have your arguments well in place, your paperwork ready, and a deferential attitude. If the Magistrate is on your side, or if the other side gets cocky (likely in this instance) You will have an openly biased person of power in your corner, and they can't be discredited for that bias. It's not a very just system, but it can be worked. If a magistrate likes you, you swing a mighty hammer.

Most of 'em can also be bought, but not for the money we're talking here.

Yeah I did read it. It was a very good post!

Just Fyi, one of the open tasks at this moment is to allign or atleast flag inconsitancies between our websites. This should only consume time but still this is not being picked up by anyone. Yet it requires no real skills.
And it may sound like I am attacking Biomech with this comment, but that is not intended.

PM me with the details. I'm off to bed right now, as it's 2:27 AM and I have shit to do tomorrow, but this sounds like something right up my alley.

I have lots of skills that might not be considered real Cheesy

I also have a couple promo ideas that just popped into my head. No details until I think about it more, cuz I'm tired and it might end up being stupid. One of 'em involves gambling. Don't know your stance on that, but I'm a gambler and I support gambling as valid promotion. If I do that one, I'll do it on my own hook and say so, but it'll be denominated in EAC.

And with that, I'm off to bed. I want this coin to succeed, and will help in whatever small capacity I can offer.

Also, I have a lot of experience as a manager in food service. I'm not sure where that skill might be helpful, but if you or others have use of it, let me know.
2509  Alternate cryptocurrencies / Announcements (Altcoins) / Re: [2014 FLAGSHIP ALT] *EarthCoin* EAC +1 Community, +1 Exec Team, +1 Best Talent on: March 06, 2014, 09:11:44 AM
I have been considering this as well the last few days. You and biomech make a good point about asics. I have also been considering what Wes had said about changing the script. Making extensive changes may not be the way to get accepted on the Chinese exchanges; it's all a big guess, takes up time and resources, and may do no good in the end. I think the community needs to have an in-depth discussion on the pros and cons of any technological changes.

I think focusing our resources towards branding, social aspects including charities and community, and building our infrastructure may be a better way to move forward.

I have also been talking with some Chinese alibaba sellers; they have some interest in porting their stores to Earthazaar. Maybe with enough trade and the right types of branding and promotion we may not need to pursue these exchanges, they may start organically adding Earthcoin.

I would support implementing Kimoto Gravity Well... nothing else... anything more is not worth the time and agro. I just went through a fork with the Klondikecoin team as a support person... meaning I provided hash-rate... to reduce block reward and etc... has nearly killed the coin... and the team... at one point my farm was mining 4 separate forks. The network hash-rate has fallen to vulnerable levels... sub-200Mh/s... and the trade volume is critically thin... the coin is on life-support... it will only survive by the sheer determination of the community and team. And the products and services that can be bought directly with KDC is far greater than EAC. The miners have left and the buyers/sellers cannot trade... and for the record... I was publicly opposed to the fork.

The one thing that has kept me 'loyal' to EAC is the strength of the coin code. I have never been involved with a coin that can take so much abuse and keep coming back. Only week ago or so during the last x5 rewards day... EAC had a network hash-rate of 16Gh/s... it was getting hammered with spikes of 6 - 8Gh/s without a hiccup... no forking, no issues... to me that is a real testament to the coin dev who wrote the code for EAC. And a matter to not be taken lightly. Anything that jepoardises this stability I am opposed to.

The only real thing that needs to change with EAC is for the Dev team to come out from behind their smokescreens and get dirty. Look at NobleCoin and KlondikeCoin... younger and much weaker coins with much great services and assets.  After 3 months... we don't even had an Android app... Mint launched with their own exchange... don't try to bluff me with your 'busy' behind the scenes, we need to feel secure' stunts. Either there is a development team or there isn't. So far there isn't because EAC has been completely dependent on the community to survive. So make up your minds, either develop the coin or hand in your retirement papers.

You(Centurion76) have to take a lion's share of the credit for EAC being where it is today. You have publicly put more time and effort into EAC than the dev team combined. Can you add Raspberry PI's and Gridseeds to Earthazaar?

So yes... I agree with you...

I think focusing our resources towards branding, social aspects including charities and community, and building our infrastructure may be a better way to move forward.

I agree with you completly. Focus toward branding and social aspects and such should be main priority and could be started right this minute. But somehow we find an excuse not to do so each and every day. I wonder if there will be any change to what needs to be done in the coming few days. I have the feeling that the IRC chat and waiting for the premine results will get us stalled even further. And maybe we find something else to stall us even further.

So maybe I should ask just 1 question: What emotion is holding you back to actually help EarthCoin?
In my case, no excuses. Just lack of resources, or direction I suppose. I'm trying to put some things together to sell on Earthazaar. I have served as something of a cheerleader, because I'm dead broke and it's the best I can do at the moment.

I can't say I don't care what the devs have to say, but it won't change my position much, if any. BTW, did you get a chance to read my post at earthcointalk yet?

As a suggestion to the devs (and I hope I can get in on the IRC chat) I would suggest they read the way Ultracoin handled their premine. That, I thought, was pretty innovative, very open, and highly likely to boost the exchange price of the coin.

I got my BTC refund today for 3 Neptunes (43.569). exchange rate used was at $700 by the time I got it, rate was down to $660.  Took 8 days to complete the transaction and BTC went on some wild swings,  had no idea where it would be and they gave me no information on the exchange rate other than they will use BitStamp price at the time of transaction.  Considering that I spent under that amount to purchase 4 Neptunes, made out pretty well.    When it arrives every mBit it makes will be profit...  good to hear they taped out...  Wasn't really looking forward to re-wiring my house to install 4.

good times.

Tell us more, please! With gridseed units, I'll pretty much guarantee you could do significantly better than 10MH/s, and I personally have NO reason to limit myself to Scrypt. BTC miners are looking at a negative income from their ASIC devices in the near future at the current rate of expansion. 10K isn't that bad to indefinitely extend the useful life of a 20-30K investment.

Worth it for the PR, yes, secondarily. Worth it to profit off of established miners AND those with BTC/EAC to invest in the future? Priceless.

The catch is that, you need the batteries to store the juice for 2-3 days of low-no sun,  so even at 100watts, thats 2.4 kWh a day of power generation and storage at roughly 75% efficiency (so you need to grab and 'store' 3.0kWh) For just 100watts of hash-power.    That isn't a huge investment but its not cheap!   But it would make cool PR

Its funny, after thinking about this,  my entire house doesn't use much more than 3.0kWh a day,  or what would be needed to run 1 gridseed.

Crazy!

So, aside from storage, your system is straight solarvoltaic?

I'm admittedly new to Eligius, having come from Slush and I'm hoping someone can educate me a little, I seem to have had a period of about half a day where I've been hashing fine but my balance of has not increased and is as low as if I'd not been hashing at all, I've attached pics of the relevant portions below. I've not registered any particularly high amount of rejects that I've noticed, but it did coincide with the CPPSRB failsafe mode trips, is there any connection? Is this normal occasional behaviour? (Am I just being stupid?) I'm not really concerned, more curious.

You're not being stupid, it's a valid question. I'd keep track of it to be safe, but it will probably catch up as the database catches up. Generally when the thing goes in failsafe mode, the stats are hosed. Some work, some don't, none are accurate. A few minutes to a few hours after the warning goes away, everything seems to be square again. Basically, as long as you're getting accepted shares, the pool and payout are working correctly. When it gets way behind, like it is now, Wizkid does a manual payout at some point. Usually not a long wait, either.

I've never mined slush. I've heard good and bad about them, but not enough good to switch. I'm relatively new to mining, and had problems with several pools I tried. Two worked as advertised. BTCguild and Eligius. I like Wizkid and Eligius better, and I like that I can set my fee. (I'm not a mooch, so I DO donate).

In both instances, when there's a real problem the operators are right on it. The stats page getting hosed is more of an annoyance than a real problem in my arrogant opinion.

Welcome aboard.

Finally someone in scrypt coin talking sense about ASIC's!

There is nothing magical about ASIC's. They simply perform one or two tasks very efficiently. That's GOOD for scrypt coins. the fact that people are developing them means that this algo is NOT going away.

SHA-256 ASIC's are relatively easy to make, whereas the Scrypt algo adds in a very memory intensive additional task. Basically, this means that you need ram as well as ASIC's, and ram is more expensive to manufacture. However, it's also common as dirt. There was only one way that ASIC's wouldn't come to scrypt, and that was the failure of the coin(s).

I am going to make brash statement... GPU farms are dirty, destructive, resource-hogging, environmentally-unfriendly, inefficient, expensive disasters waiting to happen... that is coming from someone(myself) who is well known among friends as a hard-right wing, petroleum guzzling, capitalist pig!

I own and maintain a 15Mh/s system... it requires 7500KW of power, has turned my nice cool basement into the hottest room on the property and needs regular maintenance and repairs... all for only 15Mh/s.

We have to embrace ASIC's... it is the only way forward. GPU farms are simply too wasteful.

You made a post somewhere in this thread about a steam/solar/generator/mining system... nearly impossible with a GPU farm... even the most efficient 3x270 rig requires 600W 24/7 for only 1.3Mh/s. But with a small, efficient ASIC miner, you could run a 1 to 2 Mh/s system with a solar panel and wireless connection.

Earthcoin... GPU farms are not earth friendly... if that is something you are concerned about.
Yeah, I agree here. The Gridseed scrypt asics are running 3.5 MH/s for 100ish watts, and they are out there right now. Fighting the tide is useless, even if it were desirable. I am of the strong opinion that the future of mining depends on both the development of ASIC devices (of which all of the current ones are crude by comparison to what they can be, regardless of process node) and off grid power. As for the the specifics of power systems, I'm talking with Phoenix1969, who has already started some research in that direction, and doing my own research. Off grid power is something I have been interested in for several decades. My father is an electrician with an imagination, and he and I have discussed it for all of my life. The approach that seems best to me has batteries as your main feed, and a bunch of different things charging those batteries. Solar steam is an interesting one, and largely undeveloped as most developers are looking for large scale generation. Even in this, Centralization rears it's ugly head and heads off thought. But a combination of solarvoltaic, solar steam, wind, and where available, small scale hydro seems to me to be the way to go. So much so that I am trying to develop it as a business, with mining as my main focus.

You're right, it would be good publicity for earthcoin, as all of those solutions are either non polluting or a very small footprint. The batteries that I favor are deep cycle batteries such as used in golf carts. They are old tech, and if you take care in their maintenance, non polluting. The rest, there is some pollution in the manufacturing chain, but not much. Small scale hydro can be done with water wheels turning automotive alternators. They are made to work under variable RPM and find their way into landfills and smelters in great quantity. As far as I'm concerned, that's a huge waste of readily available resources.

EDIT: Typos.

FIY,  I live off grid and have for years.    Its not impossible but it would be pretty tough to run even small mining/nodes totally autonomously.  Much easier in the sun-belt.  But you are talk a ten-thousand dollar investment up front, to secure maybe at best 10mhs of scrypt ASIC power 24/7 with minimal downtime.

I could build that system easily the question is,  is the PR worth it? Wink

Tell us more, please! With gridseed units, I'll pretty much guarantee you could do significantly better than 10MH/s, and I personally have NO reason to limit myself to Scrypt.
