Actually, I just did some research on what that guy is talking about. According to the trollboxarchive, in the last 24 hours you've posted these messages in btce message box (as the moderator):

"ltc and ftc are coming to gox"
"mtgox twitter is showing some funny business! FTC is coming to gox"
"believe, gox is bringing the new server in now with ltc & ftc"

Those are just some of the feathercoin pumps you have been spamming in the chatbox. Not to mention you banning people who dare to voice a negative opinion on feathercoin.

People of the forum, ask yourself if a person who spreads lies about feathercoin (FTC) going on mtgox, purely to pump up it's value, is the type of character you can trust to run an escrow service. Members of btce respect the moderator and hold his opinion in high regard so I would say that counts as abuse imo.

I've got no idea why you are writing me a wall of text. The definition is quoted straight out of the definitions section of the guidance document. "An exchanger is a person engaged as a business in the exchange of virtual currency for real currency, funds, or other virtual currency".

For clarity, this is the exact part of your original post that is wrong: "FinCEN has definitively and clearly indicated that an entity which exchanges virtual currency for real currency is NOT a "(1) Currency dealer or exchanger"

No please don't add misinformation.

FinCEN has definitively and clearly indicated that an entity which exchanges virtual currency for real currency is NOT a "(1) Currency dealer or exchanger"; they are a "(5) Money transmitter".  All of it is laid out in the cite above.   Please don't try to apply common sense to the law.   While you may "think" it would "make sense" for an exchanger to be under category 1 you would be wrong.  It is one thing to be wrong, it is another thing to spread misinformation.  

You're actually completely wrong. See the recent FinCEN guidance pdf: http://www.fincen.gov/statutes_regs/guidance/pdf/FIN-2013-G001.pdf

Note on page 2, under the heading "Definitions of User, Exchanger,and Administrator" it says: "An exchanger is a person engaged as a business in the exchange of virtual currency for real currency, funds, or other virtual currency".

Now there is a funny thing about this genesis block. The coins of the genesis block can not be spent! At least this is the case for bitcoin.

Hydro there's been successful legal cases against people who've stolen virtual money or destroyed it. I read one just the other day about a girl in the UK who prosecuted who guy friend who got mad at her and destroyed or gave away her massive stash of in-game virtual money (it was on the bbc news, I can find the details if people are interested). The dude actually got a criminal record for it.

Yeah, but those 3k LTC nick took could be worth $150k in a year or so.

Hopefully he won't get away with this.

I've my passport ready to go.  No one here on the forums will do anything.  I  will.  I'm just asking for help to cover costs for my trip to meet and greet him.  I'm not even a miner but a LTC scammer has to get his day of reckoning.

us.  I've many friends in Europe that will keep lodging costs minimum.  It's mainly the flight ticket and food.

What's the point? If you go over there and beat him up you'll just get in a lot of trouble with the law. If you go over there and shout at him, will it really make a difference?

The correct approach is for the affected parties who care enough to form a class action suit against him and take him to court. Ideally, people living in his own country.

Alternatively, if you guys can ascertain beyond all doubt that he is the guy and he is guilty of stealing funds, then create a website with all of his personal information, pictures and what he did on it and publicize it heavily so it goes to the top of google search results. Therefore whenever a future employer/girlfriend/etc googles his name or email address they will know what a thief he is. Not sure of the legality of that though so I wouldn't recommend it.

Hey, sorry for not posting the past days. Here is some news for you:
We just sold anything we had to a small indian company for a reasonable price. It was fun but all 3 of us are kind of happy we are out of this now. At least we didn't make any losses in the end.
Before anybody is asking: the company doesn't want it's name to be revieled, that was part of the contract.
But as far as I know the company wants finish the last few issues in design and then sell to the public.

1. Is kraken.com registered as a money service business?
2. Does the company have the necessary money transmission licenses for the 48 states of the U.S which require them?

The guidance indicates operating an exchange to those 48 states whilst not meeting 1 and 2 is in violation of US law (even if the exchange is not physically located in the US, but merely serves US customers).

You're right!  Like MtGox, BitStamp, Coinbase, etc., once launched we'd qualify as a money transmitter in most US states which means we'd require licenses (or an exemption) in each US state in which we have a customer.  Most people believe that it's enough to be registered federally, or to locate your business outside the US but, as you've pointed out, if you serve US customers, wherever your business is domiciled, you need to be licensed in the state(s) in which those customers reside.  We'll reveal our US coverage at the time of launch.  Obviously, it'd be irresponsible to put customer funds at risk of seizure by operating illegally and that is not something we intend to do.

Cool. To clarify, would you have the necessary money transmission licenses before you start serving US customers or are you going to risk it and just start serving US customers with only a money service business registration and no licenses? I'm sure your company has intentions to get the licenses at some stage, the important thing is whether you start accepting US deposits before you get them.

It would be illegal, punishable criminally and greatly reduce our chances of being granted licenses later if we were to begin operating without the necessary US state money transmitter licenses.  I think it's great that some businesses are willing to put their necks on the line to serve Bitcoin adoption but it's not a risk we're willing to take for ourselves nor your money.  We will not serve those customers we cannot legally serve.  For illegal exchanges, you have the three options mentioned above, and many more.

Great work. You're a credit to the community. It gives me confidence in the future of Bitcoin that there are finally exchanges that are going to do everything by the book and to be frank people don't realise how desperately we need this. A lot of exchanges spin similar lines but when you get down to the nitty gritty of it all, they don't have the licenses.
