I really don't think it is. Granted IANAL, but the precedent in most industries is that if the unit is priced at USD$XX.XX and you pay BTC/EUR/CDN$YY.YY, when you get a refund a month later you will get back BTC/EUR/CDN$ZZ.ZZ, worth USD$XX.XX. If you go before the arbiter and that quote is the only evidence you have that HashFast promised to pay back the same amount of BTC, I would be surprised if the judgement went your way.

Orders are taken in BTC, in the unlikely event we get to refunds they will be given in BTC. and personally at this point im hoping there are major delays and i can just get a refund of my exact amount of coins. Its clear at this point the correct move would have been knc and as much as I dislike BFL, BFL may end up shipping before hashfast.
Hate to be the bearer of bad news but you are not going to get a refund of "exact amount of coins". Prices were in USD, invoices in USD, all advertising in USD. If you get a refund it will be in USD. If you want that refund paid in BTC (instead of say a bank wire) it will be at the exchange rate of the day. The only way you are getting exact coins back is if by some small miracle the exchange rate crashes back to the same one it was on the day you paid. You don't have to believe me, and don't attack the messenger. You can hold out hope and wait for Hashfast to contradict me but that contradiction isn't coming. I don't think this is correct. When I visited HF last week John specifically mentioned that refunds would be done in the currency it was paid in at the amount paid in at the time of the order. So if you paid 50 BTC you will get back 50 BTC. Another topic was the possibility of refunds and John was pretty specific that if refunds do happen they will be full refunds in the currency the order was paid in (BTC in BTC, USD in USD).

Dont need to present evidence at all . I have my receipt of sending them 59 btc. They said they offer refunds after Dec 31st. Hence refund what I gave. Very similar to a barter. I am due what I gave, or present value of the item that was bartered with, to replace the item I gave. Pretty easy concept, and backed with years of small claims court case law. Anyways, i digress... this discussion is all very useless as we will all need to initiate our own remedy after the date has passed. We are clogging the thread from a meaningful reply from hashfast's paid community liaison, HashFast_CL.

I was looking for information on how to operate the Baby Jet when I receive mine hopefully sometime this year. Are there any instructions on how to operate the baby jet? I am also searching for instructions on how to install the upgrade kit as well. So far I have not been able to find anything on those two topics yet. If anyone has info on those two topics I would greatly appreciate an update.

Sorry not going to post it. Even though i'm sure they can figure out who i am, I would rather them not know exactly. Going have to take my word, which in this community isn't worth much i guess. yes, I'm disenchanted with the mining part of the community if you haven't figured that out. There is really nothing to hide, the invoice sent by email shows the amount in USD and (x BTC) among parenthesis.
Not mine. Wonder how many permutations there are. Just like all the different TOS versions. The one posted on the site on the day I bought is different than the one appended to my order confirmation (yes, I have it saved). I think they kind of screwed some of this stuff up from the beginning, and imagine that there's inconsistency in many places. All unimportant, however, if they do their first batch shareholders customers whatever right. We'll see.

That quote I do remember. They were asked if they would be given the same amount of BTC, but the answer does not say that. It only says that orders were taken in BTC and refunds would be given in BTC. He didn't say the quantity would be the same. As far as I know, the only statement saying the that the quantity would be the same was ninjarobot's hearsay account from his visit to the office. Well , if there is anyone on this forum who paid in btc , he could trace where the payments went. If we come across a wallet full of btc that match 30-40 or so orders , there is still hope. If they went to an exchanger , kiss them goodbye. Also the third , where we can't trace them , which bring both fear and hope.
