It's just a money grab, they don't need any help with the refunds. I didn't received it. Sure that it's legit? (just check the headers).

HF can determine whatever exchange rate they want. There's no way you'll win in court unless they promised you, specifically, full BTC refunds.

I don't think you're right, but these losers aren't going to sue, anyway.*  Nor are they going to work together.  They're just gonna bitch and moan while they get reamed up the @ss by Eduardo and company.

How many of the batch 1 customers have appeared here? A few dozens?

I think many are watching, and waitinf for the situation to unfold.

I think it's premature to determine how much of them will take up arms, based solely of the traffic in this thread.

For example, I don't intend to stand aside (or bend over), but I did not comment until now.

(If my intuition is right, HF is trying to measure the ratio of "problematic" customers just now, and that is one of the reasons behind their latest mail.)

For those of you who do not want to sue Hashfast but are planning to get a refund in usd converted to btc please pm me first

I am offering the following for a limited amount of units, The amount paid for the unit in current btcrate converted to usd +5%

So for example
If the price is 750 and you paided 5700 I will pay you 7.98BTC

Basically you will get 5% more then hashfast is/will give you and you will get it asap vs waiting on hashfast.

@gmaxwell, yes, you are right, it's not about cojiones, it's about the risk benefit ratio. I have more to loose. HF however will fight to death.

You just told them that you don't want a refund and you are ok with late shipping, as long as they ship it as soon as possible. Why would you do that?

The terms say the refunds will be in the currency in which they were paid... which seems straight forward... but then they amended it later to say at the exchange rate in USD... so they will give you the initial USD purchase price in BTC.

So... while the initial wording seemed pretty clear that they would return the exact funds... they changed it when BTC went ballistic.

Why don't you post a copy of the original TOS instead of just making a claim?

Amend?? Amend my a$$. Nowhere in the TOS for Batch 1 does it say they'd use any USD exchange rate for BTC refunds...If you are talking about that recent email today, that's not a TOS. That's just a last minute, play-dumb email that can never replace the original TOS.

I thought about doing something like that too. But then I did the math, and realized that it's basically no better than what antminers cost, and antminer's don't have the risk of doubling down on hashfast delays.

John Skankywhore (I forget his real last name), the director of marketing, previously worked marketing bondage, fisting, and other kinds of extreme porn for the holding company that has kink.com and its family of sites.

Just to be clear, personally I'm not against porn per se, but it's an interesting career choice, and John's specialization in its most extreme (legal) form now seems to suggest something about his personal ethics.  

I wanted to give him a pass about that back in October - a second chance, call it, everybody deserves one - but it seems clear now that Hashfast marketing has equally severe ethical challenges as the business of filming economically desperate women submitting to potentially damaging abuse, I mean, sex procedures.

I'm good with websites.

I serve every day millions of pages to hundreds of thousands of different people.
I was invited to visit Google's HQ.

Yet, i don't have a workable solution on how to kill HF's sales. I can't spend 10k$-100k$ per day on adwords, they can.

Cedivad seems to be the only one with the cojones to actually sue.  
It's not a question of courage. It's a question of expected return.

This is ultimately the reason I ended up not suing Butterfly Labs over their shenanigans with my orders.

Actually spent the refund money on a lawyer, and recognized that it would be throwing good money after bad to fight off a baseless Defamation Countersuit in addition to my Breach of Contract Lawsuit.

It just wasn't worth it after considering the variables, and used it as a learning experience to never deal with pre-orders in Bitcoin space, and to never trust Butterfly Labs or Josh Zerlan ever again.

If I can steer one person away from purchasing a product from Butterfly Labs, it will have all been worth it.

Hashfast seems to be even more dishonest by the looks of it, and that's the stunning part.

What I wouldn't give for an honest and reliable manufacturer here Stateside so I could "Buy American". As it stands right now, every American-based company attempting to manufacture Bitcoin mining hardware has redefined legal conniving business practices.

2. PURCHASE AND PAYMENT.
(a) Guaranteed Baby Jet Delivery Dates. All of the 550 Baby Jet units from Hashfast's first production batch are guaranteed for delivery by December 31, 2013. If Buyer ordered one or more units of such Baby Jets, and Hashfast does not deliver such units by that date, then Buyer may cancel the undelivered portion of the order at Buyer's request and Hashfast will refund the payment for the units that Buyer purchased but did not receive and cancelled. This cancellation and refund is Buyer's sole and exclusive remedy for Hashfast failing to deliver by the December 31, 2013 guaranteed delivery date, and Buyer must cancel the order by January 15, 2014 to avail itself of this remedy.
(b) Other Delivery Dates. Except for the delivery dates described in Section 3(a) above and delivery dates explicitly guaranteed using the words “guaranteed delivery” in the order confirmation sent by Hashfast: (i) delivery dates communicated or acknowledged by Hashfast are approximate only; (ii) Hashfast shall not be liable for, nor shall Hashfast be in breach of its obligations to Buyer because of any delivery made within a reasonable time before or after the stated delivery date; and (iii) Buyer will give Hashfast written notice of failure to deliver and ten (10) days within which to cure. In any case, Buyer's sole and exclusive remedy after such cure period or guaranteed delivery date is to cancel the affected and undelivered portions of the order, and receive a refund for the undelivered portions that were cancelled.
(c) Products shall be delivered EXWORKS (Incoterms 2000) Hashfast’ manufacturing facility, or other facility as designated by Hashfast, unless otherwise agreed in writing between Hashfast and Buyer.
(d) In the event Buyer contests delivery, the Buyer must request a proof of delivery from Hashfast within ten (10) days of the date of Hashfast' invoice or guaranteed delivery date (whichever occurs first), otherwise delivery shall be deemed completed. If Buyer fails to take delivery, then Hashfast may deliver the Products in consignment at Buyer’s costs and expenses. Timely delivery requires Buyer to provide all necessary order and delivery information sufficiently prior to the agreed delivery date. Delivery may also be contingent on full payment. No order, Agreement or any part thereof may be rescheduled or cancelled without Hashfast’ prior written consent except for cancellations permitted under this
