Hey HF thanks for giving another US company a bad name.  I'll be buying from non US companies from now on since the US ones are full arrogant lying a holes.

You know, there is absolutely no reason (IMO) that you have to use HashFast's "REFUND REQUEST AND RELEASE" document to process your refunds.

You can just edit it and put in your own terms (to make it easy on them during processing, use the same template).

You (as far as I know) are required to notify them of your intent. You are NOT required to use their written terms in their own desired template form. You can submit your own request with your own (similar) wording.

Everything I read in their version is designed to negate a persons ability to get their BTC back even when no conversion took place from cryptocurrency to fiat. Why should you use their original form? If you are under the delusion that you have to use their form, you don't. You can make your own.

Make your own. Then, as required of you, serve them with the refund request you detailed on your own terms.

I sued BFL and won. Since I live in California, I had to hire an attorney in Johnson County KS. I won by default with damages and atty fees awarded, as BFL failed to show at trial.
My case is a matter of public record, case 13LA09619
BFL has now failed to respond to their loss of the suit and we are looking for ways to collect via lien, direct bank account deduction, etc. In addition we will be shortly expanding a second lawsuit based upon the proof of fraud whereby our bitcoins will be returned to us via a court procedure known as 'recession' [where the court orders that you are returned to the same position today that existed before the fraud occurred] and will seek to secure our bitcoins by way of a replevin order.
These processes are time and money consuming, but as BFL continues to ignore the court orders, their fines and fees are increasing from the date of our original judgment.
The chief obstacle for execution of a recession and replevin order is the notion that bitcoins [even though digital] are a type of property that can be 'seized' or returned, by an action provisioned under instructions given to a sheriff acting on orders from the court.
Of course, we crypto-geeks know that this can be easily accomplished, but BTCs are a new "unknown" to the US jurisprudential system, and our attorney has to guide them through the process and allow them to conclude that "this can be done".
If anyone is interested in filing suit against BFL remotely, I have an EXCELLENT attorney-- and since he has already won the first suit, it is a foregone conclusion he can win yours.
Now the caveat: BFL is very skilled at moving its money and its accounts around the various banks in Leawood Kansas. Our investigator has determined that they had accounts in certain banks which are now closed, but we suspect that they are no longer using the registered corp-name BF Labs Inc as the corporate name on the account they use to pay their local employees-- and they DO have to pay their employees somehow.
Speculation is that they have moved to using ADP or another third party payroll system and have masked their accounts.
We are pursuing a subpoena to force a court appearance by Sect/Treasurer Jody Drake to disclose the location of assets.

This has been an expensive process, but BFL should not be allowed to defraud the public.

Eligius seems to have only said that a specific account isn't theirs.

So you should all ask a representative, has HashFast ever used/tested on mainnet [with customer equipment]? If they have, did it ever produce any amount of BTC?

If so, then there, you have an answer. If he doesn't release a statement one way or the other one can only speculate on what the facts might be with non-definitive conclusions.

Yes, the Eligius boss was kind enough to specifically repudiate the purported evidence showing HashFast mining with customer's hardware.

Since then, no other evidence of HashFast self-mining has been provided or even suggested to exist.  Therefor, the charge should be withdrawn.

In a normal Scam Accusation thread (whether misfiled in Custom Hardware or not) the accuser provides their evidence and is expected to withdraw the accusation if the supposed evidence does not prove what is claimed.

I've already responded to the self-mining accusation:

We have internal test systems.  A few of them, like the Baby Jet in our office that is part of the Eligius mining pool, are doing actual mining.  This is to do a full, end to end, system test.  None of these test systems will be shipped to our customers.  We will not use customer systems for our own purposes, especially mining.

Hmm someone mentioned you should start arbitration long time ago.  You must like wasting money.

Why would anyone "start arbitration long time ago [sic]"? Until there was a failure to deliver on Dec. 31 there was no claim to arbitrate.

Order prior to 15 AUG had no mention of Dec 31.  They have been in violation of their original TOS for months now.
