Nothing in court guys. They forced us to an arbitration. There will be an arbitration.

That isn't always true. You haven't received your product, your rights as a consumer are different than if you had bought and received something under a term of sale including arbitration. Hashfast will try and ship you something, because then they have completed the sale process and you would be suing for damages because of the late shipment. That part would probably be stuck in arbitration. They may currently be guilty of criminal fraud, and the arbitration won't mean a damn thing recovering damages if they were found guilty. Anti SLAPP laws in CA will prevent them from trying to sue the victims of their breach of contract for libel.

Not only was there an arbitration clause most courts want you to mediate before trial anyways.  Also HF did the it's only for commercial use not for retail customers thing because by law it means you were a sophisticated customer not some consumer who should believe random Internet postings.  All these other moves are a waste of time and money.

Dear Batch 1 Customers,

Although HashFast has enough Golden Nonce ASICS for all Batch 1 orders, our initial modules (Rev 0) had reliability issues due to the PCB layout (Printed Circuit Boards). We have now received 2nd  rev PCBs, and they are currently being assembled and will then be tested. 

Despite these challenges we did begin shipping our very first  Batch 1 orders today. These units were hand-built, tuned and tested.  We have not yet started bulk production due to continued debugging efforts on the latest PCB revision. 

We had hoped to resolve reliability issues sooner so that we could begin bulk production and be on track to ship Batch 1 customer orders on December 31.  However, issues have not been adequately resolved, and therefore we are unable to ship the remaining outstanding orders by December 31st. 

For customers who would like to request a refund, please do the following:

No HF I don't want Rev0 hardware that you know is unreliable.
No HF I don't want to waive my rights to a BTC refund.
No HF I don't consent to wait another month for a PCB revision.

STOP treating your customers as tools and pawns. We are customers, not captives.

Your failures are your own, stop shifting the risk and losses to your customers and live up to your own promises.

No that can't be legal.
Earlier ToS said we had 15 days from December 31.
Furthermore, that 10 days deadline is not mentioned in the email which links to that form.

Eligius seems to have only said that a specific account isn't theirs.

So you should all ask a representative, has HashFast ever used/tested on mainnet [with customer equipment]? If they have, did it ever produce any amount of BTC?

If so, then there, you have an answer. If he doesn't release a statement one way or the other one can only speculate on what the facts might be with non-definitive conclusions.

I have come to believe that Eduardo is a man with integrity, driven by the goals and beliefs of a true Bitcoiner, i.e., a belief in transparency, openness, honesty, and hard work.

I believe that Eduardo's goals are noble and that you will believe this also once he announces publicly his plan for buyer refunds and the Miner Protection Plan.

Their goal is to under promise and pleasantly surprise.

The fact that only Luke-Jr confirms shipping does sound a lot like BFL. In order to win a bet that BFL would ship the first units before April 01 2013 they sent 1 unit to Luke-Jr. However it was never actually shipped because Luke decided to leave it at BFL. It took until July for day 1 customers to receive their units. https://bitcointalk.org/index.php?topic=163261.0
I only say it how it is.
Neither BFL's developer-friendliness nor HF's lack thereof are at all relevant to the fact that FedEx called me and (among other things) gave me a tracking number.

let's not kid ourselves by pretending it's a coincidence you are getting a unit early, they obviously are abusing your status in the community to ship you a unit hoping to get a review to cool things down a bit. Can't blame them.

Care to to tell us your (rough) order number so one can judge how many units should be shipped out before you? Easy to verify....
