This is a really interesting detail.
They are trying to buy people who bought with BTC because they have that liability, but they don't give a duck about people who bought via USD, while i was supposing that they tried to reimburse them as well to have the hardware for themselves and not have to ship it. So it means that they are not gonna ship anytime soon.
At least following this line of tough.

Just received a USD refund letter + check in response to my original full BTC payment refund request on Nov 10 and Jan 2: https://i.imgur.com/BMRKKs5.jpg?1For reference, my refund request is hereI did not fill out their USD refund & release form and did not request this. Getting so tired of these games. Wow, they are shameless engaging in deceptive practices. Notice they failed to provide you with an explanation about the exchange rate used to pay the order, completely ignoring their own argumentation that every customer merely used BTC to pay for a product priced in USD.

I actually think their lawyer probably advised them to settle those BTC cases with checks. I figure they thought people would be stupid enough to go out and cash it right away without a second thought. (Hey, it was worth a shot right?) The bigger question is whether they even intend to honor the MPP. If not, then you can probably go to court and show definitively they are acting in "bad faith". Which means, that no matter how innocent your purchase was, they had no intention to actually perform. If you can prove that much, you stand a good chance of opening pandoras box on their TOA and your BTC. The businessweek article citing facts is a good indication they intentionally used customer funds in their development of the product. Something that I don't think any individuals openly agreed to. They only agreed to a retail purchase of a product as far as I can see. If they bail on even the MPP that [some] customers still want, there is a good chance you can break down any argument that they acted "in good faith". One word: Clusterfuck!

I used the "report to a moderator button for that post that only included that link, since that it's the second time that it's linked, he tried to advertise it via PM to me as well, etc.
So it's 99% a poor level scam.

I never filled out a refund request (in any form).
They are FORCING REFUNDS for batch1.
Expect your letter whether you want it or not. We now get to enjoy the forced 90% loss of investment plus the tax hit.
They are creating evidence for the legal retaliation. They will use that to argument in court they were complying with the FTC rules.

today while browsing through "@hasfast"-mentions on twitter, i noticed this one guy, asking for support from hashfast and including his bugtracker-id in one of his tweets. which automatically puts all of his conversation publicly online (his fault, kind of, but something tells me at least that this is not the way you should setup a bugtracker) .. well. but the interesting bits are: a) in here hashfast actually confirms one of their postal addresses (the one in san jose); b) there ARE people, apparently, who order more hardware from hashfast even in january of 2014 (last week, actually); c) here's an order-confirmation (linked pdf) for a babyjet (batch 1) with a delivery deadline of january 31st (!) mentioned - this is the first time i'm seeing one of those. bottom of page 1. though in the attached terms of sale on page 2 this is contradicted by a delivery deadline on december 31st (as we all know), so .. (this keeps getting .. weirder. funnier. sadder. is that even a word? ah, whatever. i propose "it keeps getting hashfaster" as a new term. describing something that's so stupid and dumb and sad at the same time that there's no other word to say it.)

it is not "someone" deleting. There are moderators on boards. Go to Meta and you can read up on it. Generally, spam and posting of unrelated links is something mods should delete. Because sometimes those cool links are put up to scam people, or sometimes their lead you to malware. But, you should take this discussion to Meta. I posted what I did because I agree with the deletion and the site is an obvious scam. When the OP gives me the physical address that he is having someone visit, I will post a rebuttal when I visit and if I am proved wrong.

I poked around the site last night and I couldn't navigate to the page the OP posted. The only way there was through the direct link provided. Further, half of the widgets on the site are inoperable and/or the sidebar contains the default wordpress configuration directions.

Check or product??? Sleep Well I used the door tag to track the package and just like I thought, it originated in San Francisco. It's a FedEx Envelope... I'm beginning to wonder if they are shipping to those customers that paid direct BTC payments without going through Bitpay. It would make sense for them to try to payoff those that had the best chance of winning arbitration. That would be a good working theory... I only got a forced refund on my later direct btc order rather than my very early bitpay order (so far). Did you ask for a refund (in any form)? I was frankly excited at first thinking it was the miner since I hadn't any contact with the company. When the FedEx guy came back with an envelope, I knew it was not going to be good. Then I felt like an idiot for rushing to the FedEx office thinking I was going to be mining tonight to start digging out from the hole. Can someone draw up a basic letter for folks to use if they are receiving unsolicited USD refunds/or a settlement offer that refutes the return of BTC property? It's probably time to send them notice that their settlement offer is "refused". Just a quick question. If hashfast converted the btc he received for payment into USD then how is he supposed to pay back the same btc at todays rates. For example, lets say he received 8 million in payments and half of that was Btc, to pay back half of that at todays rates would mean he now owes everyone 40 million in btc.

you have to stop "thinking" in USD. hashfast received BTC and shouldv'e kept those, for refunds. simple as that. they don't care about other currency's value, so we don't as well.

Answer: They could just give us what they promised to give us when they took our money. Something like that. Everything else is a fraud.
