Zefir paid for two batches at the same time, 1561 btc.

So it's either the 1st payment of 1561 on that day or the second, only 10K chip difference between the orders.

Sorry that was an error, is fixed now.

In post below:
https://bitcointalk.org/index.php?topic=198489.msg2975311#msg2975311

TerraHash CEO is stating that there are no refunds for the chips, while on http://www.avalon-asics.com/ we read:
"(..) We will provide more update as they come. In addition, the trade-in and refunds are being processed."

As I explained in post:
https://bitcointalk.org/index.php?topic=198489.msg2981991#msg2981991

Receiving chips at this date is rather pointless and new solution should be pursuit for benefit of all parties involved.
Especially that receiving chips is not enough and TerraHash engineers have to produce the boards, arm them with chips, test them and ship them.

"Avalon", "Yifu G." those are great names and those names are at stake here!
I really hope that you will make a decision that will keep them clean and even rise them to legendary status, defeating all rumors once and for all.

Good Luck.

I think trade-in and refunds refer to the Avalon units...

If Avalon is sending out 40K of chips daily (and Yifu said 40-50K daily), then they are capable of delivering 1 million of chips in 25 days.
That means all of the batches that are being late could be covered according to paul3 spredsheet

Combined spreadsheet with the avalon payment address (1FGAftzSTztFSB8LMwsrdCKTyqGY6zr3sU).

https://docs.google.com/spreadsheet/ccc?key=0AiLYkKIHJaIsdHpIaGdUOWRYVUdncTNpNlVKbVhCbEE&usp=sharing

Info about the data in the spreadsheet:

Order: There are some payments that don't have the hole payment amount in one transaction, these have the same Order "ID". For example order 4 -> Payment 1: 700.6, Payment 2: 55, Payment 1: 26.5.

In total there are 54 orders, containing 97 * 10.000 Chips.

You can help out and add missing info about chips group buys

Refunds / Boycotts till they do.

No refunds according to their "no BS" terms. And boycott won't work since they have the money already.

Lawsuits would help more.

I agree - this conduct is totally unacceptable and looks like a total Ponzi scheme - using funds from new
victims to fulfill his obligation with the older victims.  some (Batch 1, Batch 2, and Batch 3) are thrown
completely under the bus.

Why should we wait any longer, I will definitely consult my attorney and proceed with legal action asap.

Waiting or appeasing is totally useless at this  point.

YIFU - no ethics, no  morals, just a common crook.

Who says you can't get a refund?
Who says people are not doing the groundwork for lawsuits?
Who says boycotts won't work?

I think having one path to a solution is how Yifu works. I'd prefer to think the community is smarter and can do all three. NO REFUNDS in America? FTC? Think not. Yifu might not like what is coming.

Code:
The FTC works for the consumer to prevent fraudulent, deceptive, and unfair business practices
in the marketplace and to provide information to help consumers spot, stop, and avoid them.
To file a complaint or to get free information on consumer issues, visit ftc.gov or call toll-free,
1-877-FTC-HELP (1-877-382-4357); TTY: 1-866-653-4261. The FTC enters consumer complaints
into the Consumer Sentinel Network, a secure online database and investigative tool used by
hundreds of civil and criminal law enforcement agencies in the U.S. and abroad.

Maybe we should refrain from the childish name calling and trying make fun of people with foreign names and focus on getting actually something done instead?

Yifu has stated many times he does not follow the discussions anymore on bitcointalk because of all the ranting, speculation and childish behaviour.

You are proving him right

PS: thank you Yifu for delaying chip delivery and increasing the batch #2 ROI ;-)

I'm sick and tired of this chinese princess and her SM slave training.

To me it's a clear matter. An analogy:

1. I own a fish restaurant and order 100 kg fish at Avafish Ltd. and pay them in advance. I can earn $5 on each fish order I sell.
2. After several weeks and enquiries that are unanswered, I get, without notice, a delivery of 100 kg fish, but it's half rotten. Thus it can only be used as pet food, which can be sold for $0.5 per kg.

Who in his right mind would pay the full price for such a delivery?

Option a: Adjust the price to the real value the chips have now (< 50%) and refund the rest / ship double amount of chips.

This shouldn't be a problem, considering Avalons purchase price of around $1 per chip.

Option b: Lawsuit to achieve this (and probably more).

There is a lawyer on the forum, Marco Santori, who could eventually be interested in a class action suite against Avalon. https://bitcointalk.org/index.php?action=profile;u=118100

http://www.coindesk.com/author/marcosantori/

Failure to perform resulting in breach of a material term of the agreement and expectancy damages.

He already looked into a similar topic in the past around BFL https://bitcointalk.org/index.php?topic=217036.msg2290818#msg2290818

I would be in with 5 BTC for a start.

How about starting a BTCT stock to raise funds for legal action against Avalon.
The action this stock would get would be incredible..

I believe it is illegal to do this in Texas.  We brought a wrongful death lawsuit in Colorado, and that was one avenue we considered to pay the legal fees.

We represented ourselves pro se in the Federal court of appeals out of Denver.  We won several points on the appeal, by the way.

With my own past experience, I can't recommend that you pursue a lawsuit.

Sorry, but what does this have to do with Texas?  Is Avalon based there?

No offense, but may I ask how much BTC you made on Avalon hardware? Just a ballpark figure?

That would raise money. But, how about a way that is definitely legal? Though, we should look further into what you suggested. I'm sure there are lawyers around here...
There are many ways, there are kickstarter type ways, class actions, just plain raising money, etc.
Avalon is in China or ? If they are not in the US, perhaps there is a problem, but even then...

I wrote Marco Santori a PM, maybe he posts an answer here. He could say how much he needs to get this starting. As far as I know (out of American movies  Wink), the lawyer gets paid by the amount he gets out of the accused.
