Are you being compensated by BFL in any way for your development efforts or making these statements? I am making these statements of my own accord. BFL has not even suggested I make them, nor mentioned any bets to me other than Josh's seppuku thing. Way to dodge the question. So you never answered. Are you being compensated by BFL in any way for your development efforts?

I had quite a bit of coin riding on this bet, and I feel like Bets of Bitcoin is trying to cheat me out of what I won fair and square.
Aside from all of the other reasons, the pictures clearly were not posted before April. The bet outcome should be "true".

Too true. For example: The insurance policies obtained in July 2001 for World Trade Center buildings 1 WTC, 2 WTC, 4 WTC and 5 WTC had a collective face amount of $3.55 billion. The thing I never see mentioned in these pre-order resale deals is: What happens if the product never ships?
IMO, the risk should absolutely be transferred to the buyer. They are buying the risk, as well as the reward, but people never seem to mention it.

For this statement to be false, both of the two following conditions must be met:
• Before April 1st 2013, at least one BFL customer with a bitcointalk.org forum account established prior to the bet's opening date shall post detailed and credible photos of the device on the forum, including photos of it operating, and report its hashrate. This customer cannot be a BFL employee.
• The device must achieve at least 75% of its advertised hashrate.
It does sound like they met these requirements. Wow, what a slimy way to win a bet. Good thing I made my wagers on bitbet. Always read the fine print!!
For what it's worth, I agree that the bet is won, the screenshot was posted, and the date on the screenshot is 2013-03-31 so it was March, it was in Luke's possession The post happened on April 1, and the post date/time is what the bet terms specify. (Faking a timestamp on a photo is trivial BTW.) Also I don't believe it was in Luke's possession. In the photo it is clearly sitting on the same test bench as was shown in Josh's demo video, and the file metadata data shows the photo author as "Josh". Luke himself said that he "left it at BFL".

For this bet to be won tho, there needs to be a shipping label and/or tracking number. There is a difference between being an 'Employee' and a 'Contractor'
True, but he's not even a contractor. I would bet a bitcoin that BFL is not going to send him a 1099, nor are they required to. Surely he's receiving some form of compensation, be it dollars, BTC, or free hardware. Even just having his order bumped to the head of the queue holds substantial value (at the expense of the rest of the customers).

Well Avalon delivered 1-3 prototype units, @more than their advertised power consumption, just so they could say they shipped before March 1st. Then used Batch#2 funds to produce their Batch#1 orders. On those grounds the BFL 'Yes' vote wins Those were finished units installed in cases, which achieved their full advertised hashrate, and were actually delivered to customers. Luke's units are sitting naked on a bench at BFL, hashing at less than 50% their advertised speed. The pictures were also clearly posted after the deadline, so by the terms of the bet, the outcome would be "false".

Picture was posted at 1:36 AM EST. 96 minutes too late. Reported hashrate is below 75% of the advertised hashrate, if Luke ordered a Big Single. Supposedly the pictured device has not, in fact, been shipped to Luke, and is actually still at BFL, with the picture having been taken by Josh.

Unfortunately for this bet, Luke posted 36 minutes after April 1. 96 minutes after, by Eastern time, which is BoB time. Still 36 minutes after, Luke's time. Also "The device must achieve at least 75% of its advertised hashrate." Which product was your order for Luke? A Single or a Little Single? If it is indeed sitting in a Lab at BFL, I would consider it neither shipped nor delivered. Hell, it's not even finished. It's still naked.
