You know, there is absolutely no reason (IMO) that you have to use HashFast's "REFUND REQUEST AND RELEASE" document to process your refunds.

You can just edit it and put in your own terms (to make it easy on them during processing, use the same template).

You (as far as I know) are required to notify them of your intent. You are NOT required to use their written terms in their own desired template form. You can submit your own request with your own (similar) wording.

Everything I read in their version is designed to negate a persons ability to get their BTC back even when no conversion took place from cryptocurrency to fiat. Why should you use their original form? If you are under the delusion that you have to use their form, you don't. You can make your own.

Make your own. Then, as required of you, serve them with the refund request you detailed on your own terms.

Eligius seems to have only said that a specific account isn't theirs.

So you should all ask a representative, has HashFast ever used/tested on mainnet [with customer equipment]? If they have, did it ever produce any amount of BTC?

If so, then there, you have an answer. If he doesn't release a statement one way or the other one can only speculate on what the facts might be with non-definitive conclusions.

Yes, the Eligius boss was kind enough to specifically repudiate the purported evidence showing HashFast mining with customer's hardware.

Since then, no other evidence of HashFast self-mining has been provided or even suggested to exist.  Therefor, the charge should be withdrawn.

In a normal Scam Accusation thread (whether misfiled in Custom Hardware or not) the accuser provides their evidence and is expected to withdraw the accusation if the supposed evidence does not prove what is claimed.

I've already responded to the self-mining accusation:

We have internal test systems.  A few of them, like the Baby Jet in our office that is part of the Eligius mining pool, are doing actual mining.  This is to do a full, end to end, system test.  None of these test systems will be shipped to our customers.  We will not use customer systems for our own purposes, especially mining.

Hmm someone mentioned you should start arbitration long time ago.  You must like wasting money.

Why would anyone "start arbitration long time ago [sic]"? Until there was a failure to deliver on Dec. 31 there was no claim to arbitrate.

Order prior to 15 AUG had no mention of Dec 31.  They have been in violation of their original TOS for months now.

I had similar communications with Rodrigo. It's pretty apparent that unless at the end of a court order or barrel HashFast has no intention to do right by their customers. At this point I'm considering pursuing arbitration although it is almost certainly a money loser.
