If we do decide to take legal action, we will need to do so quickly, so that we can get injunctions on Steamboat's funds (including bitcoin) before he funnels it all off and files bankruptcy (which, not to be the Chicken Little here, but there's the possibility that this is already what's going on behind the scenes, while Steamboat hides away from all of us).

I still have hope that Steamboat will do what's right for the community and his reputation.    Heard from one groupbuyer who wants the case to be filed with the Florida Attorney General for fraud and prosecution, so apparently the person believes things are getting to Yifu levels.   Hopefully, cooler heads will prevail.  Apparently, it's not unprecedented that once things have been sorted out, asset seizure is not beyond their reach, even bitcoins as seen in a recent case.  As for the freezing injuction, believe it used to be called the mareva injunction and it's quite commonplace to attach business inventory of the defendant for a civil suit, but it is unknown what would be seized if the Florida AG is involved.

Yes, as I said, I think we ALL hope it won't come to that. Steamboat knows exactly what needs to happen in order to resolve this amicably.

I am also not an attorney, but I believe that he would be liable in every jurisdiction for which there was a member of the group buy. I'll see about contacting my state's Attorney General regarding possible criminal charges, if it comes to that. Civil and criminal actions would be separate, and proceedings could actually take place in multiple jurisdictions. Sounds like a world of shit that Steamboat REALLY ought to be doing everything in his power to avoid. Starting with showing his face in this thread. Wink

Why would anyone send you their information?  You can't do anything.  Also your tone doesn't exactly lend you creditability. The only option is to wait for an update from steamboat.  Getting mad isn't going to solve anything.

Why wouldn't they? What's he going to do with information that's already public? We all already know the address payments were sent to, it's not hard to see the transactions.

Building a list of people who are prepared to take things to the next level simply enables taking things to the next level. Somebody's gonna have to organize it, and it's damn sure not gonna be Steamboat... Cheesy

All of this can be cleared up quite easily. Steamboat just needs to quit cowering in the corner, man up, and resolve this thing. The sooner he does that, the sooner he can wash his hands of it. Although I'm more and more interested in taking action against Bitsyncom/Yifu, by the minute I; for one, would prefer not to see this thing escalate to the point of having to haul Steamboat's ass into court. The ball is ENTIRELY in Steamboat's court (no pun intended) on whether that happens or not.

It will take exceedingly little effort on Steamboat's part to log the fuck in here, and let us know what's going on. Much more effort, I imagine, fighting lawsuits which could include other damages including punitive, which could add up to much much more than the total that's already been invested in this group buy. If Steamboat is smart, he'll get his ass in gear and not let it come to that. I'd sure hate to see the guy lose things like his house over some cowardice regarding a group buy gone wrong (due to circumstances that were mostly beyond his control).

Oh, I see so if my chips/transaction ID are on some list that you generated means I want a refund?  Steamboat is the only one who can verify who wants refunds.  Not a third party.  I can send you 50 different e-mails from 50 different gmail accounts asking for every single chip to be refunded.  You going to add those to your list?

Steamboat has run away like a coward. The list is to organize people who are prepared to pursue legal action if it comes to that (if we don't get a resolution--or at least significant movement toward a resolution--pretty quickly). If you're not prepared to pursue legal action in order to recover your money, don't add yourself to the list. The list in question is only for people who have an interest/willingness to take things to the next level if need be.

I've written four responses to this recent situation, but canned them all.  Each grew with greater disdain than the last.  But I keep holding out for more details as to what SB's position is, which naturally adds to the negativity towards him.

Like alfabitcoin, I have 80 chips (batch 5) with full assembly, and am considering a chip refund.  Unfortunately, the bulk of my 'investment' is in assembly.  The assembly costs should not be a complete loss if there is no assembly.

I think folks wanting refunds on chips shouln't get 100% of their BTC back if they were intended to go into assemblies.

Some of us, even with chips in late batches quickly paid for assemblies in good faith to help SB get the board/assembly work off the ground. These people shouldn't be punished. The losses should be absorbed by everyone who intended to buy assemblies, so folks who paid for chips but sat on their assembly order, and who are now requesting chip refunds, should receive a partial refund of their chip purchase. Doesn't seem fair that those who did the least to help the project would get off with the least loss.

You are forgetting that SB wasn't the only assembler and chips without the assembly are worthless. It is not fair to incur assembly losses twice!

Anyway,  I just woke up and I had a dream that SB provided an update and that everything has been resolved.    Huh

I'm curious as to what deadline you're referring to?

If Yifu actually delivers the huge stock of chips he is apparently getting tomorrow, the belief is that Yifu will not refund the chips because they would be shipping them... and I believe Boxman is under the impression that steamboat wants this to happen, and is avoiding facilitating the refunds to ensure he maintains his profit.

It is concerning that Steamboat hasn't responded at all... the last we have heard, he was getting no response at all from Yifu but was desperately trying to reach him, yet Yifu has communicated plenty in threads on this forum recently and to other group buy leaders, and has issued plenty of refunds, so I am not sure why there is silence from Steamboat at this point.

There is no specific deadline in Avalon's literature, ie Sept. newsletter, the online refund form has no deadline either.  Zefir has a Wed. deadline for his group buy only.

damn dude, I gotta give steamboat props, he deserves MASSIVE respect, like it or not, he has the most organized avalon chip groupbuy i've seen.  Steamboat has been a top notch member of the community here, I commend him for doing what he is doing and dealing with some of the unique personalities here.  We need to remember frustrations are mainly caused by Yifu/Avalon's screw ups, and steamboat is ready for the chips and has done everything possible to make this successful.  I only hope yifu gets those chips out quick this week and we get some good news.  I still want my miners, im sure he has spent countless hours preparing and organizing this, im happy to be his customer.  Maybe if things get much worst and Avalon decides to fuck us even more and Steamboat is able to refund/auction off our chips/hardware,sure i'll take his advice.  But I whole heartedly believe he is not out to screw us and is out trying his damnedest to make the best of a bad situation.  

I dont think he deserves a bit of impatience or disrespect, im sure he has some solutions to the problems we got, just be patient guys, if you wanna bitch at someone bitch at yifu, keep the peace here and why dont we talk about how we are going to set up our miners?

1.36 is indeed less than 1.5.  Hence the term almost.

Almost indicates it's nearly there, as in, insufficient, not yet there. So that term would be wrong.
1.5 would indeed be in excess, more, sufficient to cover (1.36) etc etc and so would the opposite of almost.

It depends on what you mean by there in the term "not yet there".  The price is so low, it's almost just the cost of chips.  It's not quite "just" the cost of chips, but "almost" the cost of chips alone.  It's appropriate in the sense that I'm trying to convey that he is "almost" giving away assembly.  So it would not be the wrong term in the context I'm using it.
