What's there to understand?

Other than it's worrisome that this numbnuts has everyones' money.
It is a common myth that Bitcoin is ruled by a majority of miners. This is not true. Bitcoin miners "vote" on the ordering of transactions, but that's all they do. They can't vote to change the network rules.

Probably wanted to get one less board in the machine to stretch the chips further. More chips, more boards, more miners, more money. If you believe the outlandish theory that they just mismanaged their business.

Might be useful for more than just AMT. Thing is since BFL this sort of practice has become a trend. Pre-orders are one thing if the supply is there. But to put people into a position to wait after telling them in writing that their hardware will arrive by a certain time, and when they get called out get "punished" as you have, then yea this needs to stop across the board. Their lack of response to anyone on any level is pretty damning and demonstrates.

As an aside I reached out to bitmine. They will be talking to AMT putting this on bitmines radar might make a difference in our getting our stuff. Based on what is happening they need to either start talking to their customers (to be fair they have no other obligation at this point but to talk to their customers only right now). Fact is the threat of legal action is likely why they have clammed up. But they do owe their customers a status update. And that is not going to look good if a group of people decide to start filing with the FTC and then also get a bunch of lawsuits piled on them.

Filing with Delaware County Consumer Affairs is not legal action but rather a precursor to legal action.  They are required to respond within 10 days.  The agency is there only to mediate.  Failure however to respond does lead to legal action.  

I am waiting for them to provide resolution.  However,  they have the duty to respond to customer inquiries about shipping.  Failing to do so, strengthens the case.  

I also need to verify if the following AMT employees are actually real people:

If they cannot be verified to be actual names of employess of AMT,  then we are talking about fraud here.   Very serious consequences if this is indeed true.

We should all work together to provide strong evidence to bolster our respective legal agendas.

What worries me the most is the fact that AMT refers to receiving one of their miners as punishment Huh

Here is something Josh emailed me 3/6/2014:

"The miners having issues, that's why we havn't shipped. But since your pursuing all this crap we'll go ahead and ship you your miner anyway.

Which was initially meant to be a positive exchange and sharing of ideas between owners of AMT miners. I was hoping to post about our successes with AMT miners, but unfortunately there is nothing positive to post there at this time.

I also see AMT 1.2T miners on ebay, I am not so sure if these are really "Fakes". Why would a guy with that many positive feedbacks be selling fake miners?

I asked the ebayer for more photos.. he did not supply anything.  It could be a pre-order.

I think it's pretty well established what they have been doing/not doing at this point. Whatever customer support they had (meaning us stepping up to bat for them), really has gone out the window because of their lack of customer support. They need to start showing some kind of communication to their customers. Public announcements on their website for starters. Something or a mass email to their customers detailing the reason for the delays.

Take a close look at the photo Its actually using AMT's photo that they posted. Not his miner and he is selling it for 15.5k. For starters that price is insane. Secondly if he truly has the miner in hand why not take a picture and post that instead? Show all 3 miners or at least his set up instead of AMT's. Suspicious to say the least. Too many red flags to consider.

And considering his feedback shows he has shipped defective crap to people in the past. That again in itself is a red flag.

Having high feedback on ebay does not always mean much. How much of that is negative vs positive in a period of time tho is what ultimately matters.

The fact that Josh did not respond to any of the folks who volunteered to help in 'assembly' tells me that there's nothing left to expect from this AMT.

The best we can all do now is help build our legal case against the company.

Can anyone check if they are accepting new orders?  

I want to know that despite failure to deliver, whether AMT continues to accept new orders.

Title to the licensed programs delivered by AMT to Buyer hereunder remains vested in AMT or AMT’s licensor and cannot be assigned or transferred without AMT’s written authorization. Buyer agrees to respect and not to remove any copyright, trademark, confidentiality or other proprietary notice, mark or legend appearing on the software, and not to reverse engineer, disassemble, decompile, or modify any licensed programs.
 • For standalone licensed programs provided in connection with the purchase of Product(s) from AMT, AMT grants to Buyer an individual, personal, non-transferable, non-exclusive license, without the right to sublicense, to use the standalone licensed programs for its own internal use in a single computer system to evaluate, demonstrate, test and/or configure Product(s) for AMT authorized applications or to design Product(s) for manufacture by AMT only. Buyer shall faithfully reproduce all of AMT’s copyright notices and other proprietary legends. Buyer agrees not to disclose, in any form, the standalone licensed programs or any portion thereof to any person other than employees of Buyer without the express written permission of AMT.
 • For licensed or Open Source programs embedded in Product(s), AMT grants Buyer a non-transferable, non-exclusive license to use such embedded licensed programs in the AMT authorized operation of Product(s) on which such programs are embedded and subject to the terms and conditions herein. Buyer may transfer its license to use the embedded licensed programs to a third party only in conjunction with Buyer’s sale of any AMT Product(s) or Buyer product on which the AMT Product(s) with embedded licensed program is installed. Buyer’s transfer of the embedded licensed program as authorized herein must be under terms consistent with and no less stringent than the terms set forth in this document. Except as specifically permitted in this document, embedded licensed programs may not be sublicensed, transferred or loaned to any other party without AMT’s prior express written consent.

 • Excusable Delay. AMT shall not be liable for any delay or failure to perform due to any cause beyond its control or the control of its suppliers or subcontractors such as, for example, strikes, acts of God, acts of Buyer, Acts of Financial Payment Processing institutions, including freezing/holding of accounts, consumer payments, and interruption of transportation or inability to obtain the necessary labor, materials or facilities. Delivery schedules shall be considered extended by a period of time which AMT deems necessary due to the event circumstances or cause of delay. In the event AMT is unable wholly or partially to perform because of any such cause it may cancel its acceptance of Buyer’s order without liability to Buyer.
 • Limitation of Liability. IN NO EVENT SHALL AMT’S AGGREGATE LIABILITY FOR ANY BREACH, WARRANTY, INDEMNITY OR OTHER OBLIGATION OR LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE SALE OF PRODUCT(S) OR SERVICES HEREUNDER OR THE USE OF ANY AMT PRODUCT PROVIDED HEREUNDER, EXCEED THE PURCHASE PRICE OF THE PARTICULAR PRODUCT(S) OR SERVICES WITH RESPECT TO WHICH LOSSES OR DAMAGES ARE CLAIMED.??IN NO EVENT SHALL AMT BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL?DAMAGES OF ANY NATURE WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, LOSS OF USE AND LOSS OF GOODWILL), REGARDLESS OF WHETHER AMT HAS BEEN GIVEN NOTICE OF ANY SUCH ALLEGED DAMAGES, AND REGARDLESS OF WHETHER SUCH ALLEGED DAMAGES ARE SOUGHT UNDER CONTRACT, TORT OR OTHER THEORIES OF LAW.
 Transfers. AMT is required to notify all consumers in the event AMT transfers its rights, liabilities, and obligations to another organization, or and/or legal entity after the time which said transfer has taken place. You agree AMT does not require your permission to conduct transfers of AMT rights, liabilities and obligations, or sale of any other legal entity governing AMT and it’s business practices. You understand that any transfers will not affect your rights under these Terms, but will be transferred to the organization, or and/or legal entity and it will be it’s responsibility to fulfill these terms.
 • Governing Law. The terms of this document shall be interpreted, construed and governed in all respects in accordance with the laws of the state of Pennsylvania, U.S.A., excluding its conflict of laws provisions. The UN Convention on Contracts for the International Sale of Goods (Vienna, 1980) shall not apply to any purchases made hereunder.
 • Consumer Refund. AMT will only provide financial refunds if AMT is at fault for noncompliance with these terms and conditions, and any/all future terms and conditions AMT publishes and/or makes notice of.
Dispute Resolution. AMT and Buyer will attempt to settle all claims (other than claims relating to intellectual property issues) through negotiation or non-binding mediation prior to commencement of court proceedings.
 • Other Miscellaneous Terms.
 Waiver. Failure by AMT to exercise or enforce any rights hereunder shall not be deemed to be a waiver of any such right nor operate so as to bar the exercise or enforcement thereof at any time or times thereafter.
 Notices. Any notice hereunder shall be deemed to have been duly given if sent by pre-paid first class post to the party concerned at its last known address.
 Amendments. No modifications to this document shall be binding unless expressly agreed to in writing by AMT.
 Severability. If any provision of this document is held invalid, all other provisions shall remain valid.
 No Assignment. Neither party may assign its rights and obligations hereunder without the prior written consent of the other, though AMT is permitted to subcontract all or part of its obligations hereunder as it deems necessary. Any unauthorized assignment shall be null and void.
 Disclaimer for Critical Applications. Product(s) sold under these terms and conditions are not designed, intended or authorized for use as a critical component in life support or safety devices or systems, or any FDA Class 3 medical devices or medical devices with a similar or equivalent classification in a foreign jurisdiction, or any devices intended for implantation in the human body. Sale for such use is subject to AMT’s advance written authorization for product use and a separate indemnification agreement signed by Buyer. Buyer agrees to indemnify, defend and hold harmless AMT, its directors, officers, employees, representatives, agents, subsidiaries, affiliates, distributors, and assigns, against any and all liabilities, losses, costs, damages, judgments, and expenses, arising out of any claim, demand, investigation, lawsuit, regulatory action or cause of action arising out of or associated with any unauthorized use, even if such claim alleges that AMT was negligent regarding the design or manufacture of the Product(s).
 Entire Agreement. This document constitutes the entire This Agreement is the supersedes all other communications.

What worries me the most is the fact that AMT refers to receiving one of their miners as punishment Huh

I also see AMT 1.2T miners on ebay, I am not so sure if these are really "Fakes". Why would a guy with that many positive feedbacks be selling fake miners?

If you read closely, they are typically selling "pre-orders" The idea is that you buy their place in line to wait for the miner. Typically, they state that once you "win" the bid and pay, your relationship is with AMT rather than the ebay seller.

You have to read the detailed description well.

Anyone who has an order that has been "on hold" and was supposed to have received it according to their published schedule is in their right to send a complaint to the FTC, request a refund or a status on hardware. I figure if the FTC sees enough of these complaints they will take swift action to address this. The added scrutiny will at least force some answers out. Since their Tuesday updates have not happened and there is no action on the customer front (regardless of how the customer is if they request a refund they are entitled to it if there has been no product delivery on the promised timeline).

This is a case of overpromise and underdeliver. This forum might not be pleasant for them to read, but honestly they have a severe problem as google has this as the Official AMT forum right under their homepage in search rankings. It is also apparently their only public means of communication with us. They gotta either learn to get thicker skin against those who detract. Reality is talk is cheap. If they show some action in delivery or at least clearly AND HONESTLY show they are wanting to do right by their customers, then they will earn the trust of the community. But as it stands, it's not happening. People are raging with good reason. Money is in limbo. People are genuinly concerned they are being conned. Their lack of communication and lack of action or delivery merits this. Can't just do this with impunity. The repeated promises and repeated failed delivery is also a problem. I still don't think its a scam. I think they are just telling people what they want to hear and are stalling. BUT I do think they brought this on themselves because they lacked communication with their clients namely those of us here complaining.

If AMT thinks its not their fault then they really are out of touch and really don't deserve anyone's business (my opinion here). Sad part is yea they COULD blame trolls or black marketing, but at the end of the day they still had people defending them (myself included), but once they ceased communication with their clients and customers and are now "punishing" them. This became a problem. Trade laws and the FTC exist to regulate exactly this kind of behavior. Refunds are a customer right regardless of any All sales are final clause (ESPECIALLY if no product has been delivered or notification of lateness and a why which is covered under FTC regulation)

Altho there is something else that we need to look at....what's bitmines timeline on delivery for their fixed hardware? And maybe if we light a fire under their ass too we might get answers as to why we are not seeing any news. These delays should be relayed from the resellers as well as bitmine. Sending those who are due potentially faulty hardware as a punishment (according to AMT if its true) is a major problem. The customer requests a refund there should be no screwing around with that. If they are demanding their hardware on the promised timeframe they have that right too. AMT needs to deliver or provide a detailed response as to why its delayed.

This is feedback AMT. Despite all the hate you getting here is some feedback you need to take seriously if you want to avoid the mess that is clearly headed your way. This is in no way intended as a threat its a fact of what is happening with various disgruntled clients that are just wanting real honest answers as to what is happening. If you abandoned this thread to avoid the problem, thats a big problem as it seems to be your only means of communicating with people at this point. There are no mass emails going out to customers, no updates on the website other than the one that states you are accepting orders for april shipping.

Communicate. And by that I mean tell customers what they NEED to hear. Engineering updates and details. Seriously I recommend looking at BFL_josh and following his format of updating people take a page from BFL they are turning it around even if they are still notorious for being late. At least people are not suspecting a scam with them as much any more. It works and people have their questions, but for the most part its civil because he has been making an effort on their forums. OR make your own forums. Does not take much. 15 minutes you can have one up and provide updates.

To show that you still have SOME potential support I will start a forum for you...and privately hand you control of said forum so you can moderate it to your desire. The idea is that you communicate with your client base a bit. Expect an email in your inbox with the info later today.

15 minutes can save you 50 percent or more on....all this stuff happening.

I think it's pretty well established what they have been doing/not doing at this point. Whatever customer support they had, really has gone out the window. They need to start showing some kind of communication to their customers. Public announcements on their website for starters. Something or a mass email to their customers detailing the reason for the delays.

The fact that Josh did not respond to any of the folks who volunteered to help in 'assembly' tells me that there's nothing left to expect from this AMT.

The best we can all do now is help build our legal case against the company.

Can anyone check if they are accepting new orders?  

I want to know that despite failure to deliver, whether AMT continues to accept new orders.

I believe they are. If you look at the 'remaining inventory' left on the newer model miners (2.4/3.2) the numbers have gone down from what they previously were for what's "still avaiable to purchase for April".
