Here you go:

First I’m sorry you feel the need to send such messages.
 
Secondly I will add that you will not receive any compensation for what you consider late delivery. Under the terms of sale you  agreed to. It’s clearly stated that delivery dates are for information only and are non-binding. We are still going to deliver your miners as fast as we can but we are not going to give compensation for any loses you think you have incurred. 
I may also draw your attention to the fact that you have agreed to a business to business purchase not a business to consumer purchase.

That is the gist of it.

Yes. Albeit later, since it turned out my VAT number was not international and since I have to pay it anyway I paid it to them.
There are several different types of Bitcoin clients. The most secure are full nodes like Bitcoin Core, which will follow the rules of the network no matter what miners do. Even if every miner decided to create 1000 bitcoins per block, full nodes would stick to the rules and reject those blocks.

Currently I'm not sure about how KnC should/could compensate us as we may end up with profit.
Taking the max mount of coins possible in a certain time frame does not match reality for sure, as you never will get 100% accepted shares and 100%uptime.
Not even IBM SystemZ running z/OS has 100% availability/uptime - ok very close, but not 100% !

It's very likely that they take a look onto customer's profit as soon as everything has been shipped and real competition actually appears in the wild.
If appropriate they will offer updates/ gen1.5 / gen2 for better prices to returning customers I assume (like it took place with USB sticks for mining).


btw what's about profit and compensation in case bitcoin crashes down to $20?

It is really easy for anyone to prove that the DETERMINING FACTOR into their purchase was the KNC statement posted on frontpage on their website that the orders will be delivered until Oct 15th. If KNC knew they would be late, that would mean they intentionally used false information in order to increase sells, which could probably incur really high fines or other penalties, going to criminal charges against company execs and their business licence being revoked. If they can prove they were really expecting to complete deliveries by Oct 15th and did all due diligence to accomplish that, they'd still have to compensate customers and/or fully refund their orders.
KNC is in no position to play fool now and they better choose their words VERY carefully when communicating next time with their customers.

That does not matter. Damages incurred because of late shipment are not dependant on the bitcoin price. If your miner could have made 18 btc in that time the have to give you 18 btc or the corresponding amount of money. If Bitcoin falls to 20$/btc then good for them, they only have to give you 360$ instead of 2500+$. What matters is that you are short 18 btc and are to be compensated for them.

Still does not matter if day 2 customers get their tracking numbers. As long as my October order does not switch from paid to in progress to shipping they are still late.

a friend just called me, and told me he received tracking numbers for his 2 Jupiters.
So over the weekend, KNC produced 2 miners. Very good work, can't see any problems here.

If they produced the 1000 units due by tomorrow, there should be hella lot more of these posts today.

Good point I agree on.
I'm unhappy about the communication towards us as well as about the statement 'business contract'.

End of July I thought the first time about they will be late for this and that indication.
In addition I was expecting more power consumption and less than 500 GH/s.

So I'm quite happy, things turn out way better than expected (being pessimistic leads to more pleasant surprises than other way round).
I hope you get my real intention behind those KnC defending phrases, as I was on the blaming side all the time before.
And since everyone uses to bash KnC now (for good reasons), I'm switching over from 'contra KnC' to 'pro KnC' as this aspect is missing in here somehow now.

Mine are 2706 and 4006 still Paid. 2706 was june 24th pay date and 4006 was july 20 pay date. Sad no progress on either one, so the probability of me getting my equipmemt online by the 15th is really slim.

Strange. Mine is 29XX paid on June 28th and is in progress since Friday afternoon. What was your payment method?
